44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the eligibility of a relative or other designated
77 caregiver of a foster child for monetary assistance.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 264.760, Family Code, is amended to read
1010 as follows:
1111 Sec. 264.760. ELIGIBILITY FOR FOSTER CARE PAYMENTS AND
1212 PERMANENCY CARE ASSISTANCE. Notwithstanding any other provision of
1313 this subchapter, a relative or other designated caregiver [who
1414 becomes licensed by the department or verified by a licensed
1515 child-placing agency or the department to operate a foster home,
1616 foster group home, agency foster home, or agency foster group home
1717 under Chapter 42, Human Resources Code,] may elect to receive
1818 foster care payments in lieu of the benefits provided by this
1919 subchapter[, beginning with the first month in which the relative
2020 or other designated caregiver becomes licensed or is verified].
2121 SECTION 2. This Act takes effect September 1, 2017.
