55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to eliminating the state-required assessment instrument
88 in social studies and the United States history end-of-course
99 assessment instrument.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 39.023(a) and (c), Education Code, are
1212 amended to read as follows:
1313 (a) The agency shall adopt or develop appropriate
1414 criterion-referenced assessment instruments designed to assess
1515 essential knowledge and skills in reading, writing, mathematics,
1616 [social studies,] and science. Except as provided by Subsection
1717 (a-2), all students, other than students assessed under Subsection
1818 (b) or (l) or exempted under Section 39.027, shall be assessed in:
1919 (1) mathematics, annually in grades three through
2020 seven without the aid of technology and in grade eight with the aid
2121 of technology on any assessment instrument that includes algebra;
2222 (2) reading, annually in grades three through eight;
2323 (3) writing, including spelling and grammar, in grades
2424 four and seven;
2525 (4) [social studies, in grade eight;
2626 [(5)] science, in grades five and eight; and
2727 (5) [(6)] any other subject and grade required by
2828 federal law.
2929 (c) The agency shall also adopt end-of-course assessment
3030 instruments for secondary-level courses in Algebra I, biology,
3131 English I, and English II [, and United States history]. The
3232 Algebra I end-of-course assessment instrument must be administered
3333 with the aid of technology. The English I and English II
3434 end-of-course assessment instruments must each assess essential
3535 knowledge and skills in both reading and writing in the same
3636 assessment instrument and must provide a single score. A school
3737 district shall comply with State Board of Education rules regarding
3838 administration of the assessment instruments listed in this
3939 subsection. If a student is in a special education program under
4040 Subchapter A, Chapter 29, the student's admission, review, and
4141 dismissal committee shall determine whether any allowable
4242 modification is necessary in administering to the student an
4343 assessment instrument required under this subsection. The State
4444 Board of Education shall administer the assessment instruments.
4545 The State Board of Education shall adopt a schedule for the
4646 administration of end-of-course assessment instruments that
4747 complies with the requirements of Subsection (c-3).
4848 SECTION 2. Section 39.203(c), Education Code, is amended to
4949 read as follows:
5050 (c) In addition to the distinction designations described
5151 by Subsections (a) and (b), a campus that satisfies the criteria
5252 developed under Section 39.204 shall be awarded a distinction
5353 designation by the commissioner for outstanding performance in
5454 academic achievement in English language arts, mathematics, or
5555 science[, or social studies].
5656 SECTION 3. This Act applies beginning with the 2019-2020
5757 school year.
5858 SECTION 4. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2019.
