10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Sections 39.023(a) and (c), Education Code, are |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (a) The agency shall adopt or develop appropriate |
---|
14 | 14 | | criterion-referenced assessment instruments designed to assess |
---|
15 | 15 | | essential knowledge and skills in reading, writing, mathematics, |
---|
16 | 16 | | [social studies,] and science. Except as provided by Subsection |
---|
17 | 17 | | (a-2), all students, other than students assessed under Subsection |
---|
18 | 18 | | (b) or (l) or exempted under Section 39.027, shall be assessed in: |
---|
19 | 19 | | (1) mathematics, annually in grades three through |
---|
20 | 20 | | seven without the aid of technology and in grade eight with the aid |
---|
21 | 21 | | of technology on any assessment instrument that includes algebra; |
---|
22 | 22 | | (2) reading, annually in grades three through eight; |
---|
23 | 23 | | (3) writing, including spelling and grammar, in grades |
---|
24 | 24 | | four and seven; |
---|
25 | 25 | | (4) [social studies, in grade eight; |
---|
26 | 26 | | [(5)] science, in grades five and eight; and |
---|
27 | 27 | | (5) [(6)] any other subject and grade required by |
---|
28 | 28 | | federal law. |
---|
29 | 29 | | (c) The agency shall also adopt end-of-course assessment |
---|
30 | 30 | | instruments for secondary-level courses in Algebra I, biology, |
---|
31 | 31 | | English I, and English II [, and United States history]. The |
---|
32 | 32 | | Algebra I end-of-course assessment instrument must be administered |
---|
33 | 33 | | with the aid of technology. The English I and English II |
---|
34 | 34 | | end-of-course assessment instruments must each assess essential |
---|
35 | 35 | | knowledge and skills in both reading and writing in the same |
---|
36 | 36 | | assessment instrument and must provide a single score. A school |
---|
37 | 37 | | district shall comply with State Board of Education rules regarding |
---|
38 | 38 | | administration of the assessment instruments listed in this |
---|
39 | 39 | | subsection. If a student is in a special education program under |
---|
40 | 40 | | Subchapter A, Chapter 29, the student's admission, review, and |
---|
41 | 41 | | dismissal committee shall determine whether any allowable |
---|
42 | 42 | | modification is necessary in administering to the student an |
---|
43 | 43 | | assessment instrument required under this subsection. The State |
---|
44 | 44 | | Board of Education shall administer the assessment instruments. |
---|
45 | 45 | | The State Board of Education shall adopt a schedule for the |
---|
46 | 46 | | administration of end-of-course assessment instruments that |
---|
47 | 47 | | complies with the requirements of Subsection (c-3). |
---|
48 | 48 | | SECTION 2. Section 39.203(c), Education Code, is amended to |
---|
49 | 49 | | read as follows: |
---|
50 | 50 | | (c) In addition to the distinction designations described |
---|
51 | 51 | | by Subsections (a) and (b), a campus that satisfies the criteria |
---|
52 | 52 | | developed under Section 39.204 shall be awarded a distinction |
---|
53 | 53 | | designation by the commissioner for outstanding performance in |
---|
54 | 54 | | academic achievement in English language arts, mathematics, or |
---|
55 | 55 | | science[, or social studies]. |
---|
56 | 56 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
57 | 57 | | school year. |
---|
58 | 58 | | SECTION 4. This Act takes effect immediately if it receives |
---|
59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
---|
60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
---|
62 | 62 | | Act takes effect September 1, 2019. |
