9 | 9 | | period may be located in this state for the purpose of qualifying |

10 | 10 | | for the tax exemption. |

11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Section 1-j(a), Article VIII, Texas |
---|
13 | 13 | | Constitution, is amended to read as follows: |
---|
14 | 14 | | (a) To promote economic development in the State, goods, |
---|
15 | 15 | | wares, merchandise, other tangible personal property, and ores, |
---|
16 | 16 | | other than oil, natural gas, and other petroleum products, are |
---|
17 | 17 | | exempt from ad valorem taxation by a political subdivision of this |
---|
18 | 18 | | State if: |
---|
19 | 19 | | (1) the property is acquired in or imported into this |
---|
20 | 20 | | State to be forwarded outside this State, whether or not the |
---|
21 | 21 | | intention to forward the property outside this State is formed or |
---|
22 | 22 | | the destination to which the property is forwarded is specified |
---|
23 | 23 | | when the property is acquired in or imported into this State; |
---|
24 | 24 | | (2) the property is detained in this State for |
---|
25 | 25 | | assembling, storing, manufacturing, processing, or fabricating |
---|
26 | 26 | | purposes by the person who acquired or imported the property; and |
---|
27 | 27 | | (3) the property is transported outside of this State |
---|
28 | 28 | | not later than: |
---|
29 | 29 | | (A) 365 [175] days after the date the person |
---|
30 | 30 | | acquired or imported the property in this State; or |
---|
31 | 31 | | (B) if applicable, a later date established by |
---|
32 | 32 | | the governing body of the political subdivision under Subsection |
---|
33 | 33 | | (d) of this section. |
---|
34 | 34 | | SECTION 2. The following temporary provision is added to |
---|
35 | 35 | | the Texas Constitution: |
---|
36 | 36 | | TEMPORARY PROVISION. (a) This temporary provision applies |
---|
37 | 37 | | to the constitutional amendment proposed by the 86th Legislature, |
---|
38 | 38 | | Regular Session, 2019, to extend the number of days that certain |
---|
39 | 39 | | tangible personal property that is exempt from ad valorem taxation |
---|
40 | 40 | | due to its location in this state for a temporary period may be |
---|
41 | 41 | | located in this state for the purpose of qualifying for the tax |
---|
42 | 42 | | exemption. |
---|
43 | 43 | | (b) The amendment to Section 1-j, Article VIII, of this |
---|
44 | 44 | | constitution takes effect January 1, 2020, and applies only to a tax |
---|
45 | 45 | | year that begins on or after that date. |
---|
46 | 46 | | (c) This temporary provision expires January 1, 2021. |
---|
47 | 47 | | SECTION 3. This proposed constitutional amendment shall be |
---|
48 | 48 | | submitted to the voters at an election to be held November 5, 2019. |
---|
49 | 49 | | The ballot shall be printed to permit voting for or against the |
---|
50 | 50 | | proposition: "The constitutional amendment to extend the number of |
---|
51 | 51 | | days that certain tangible personal property that is exempt from ad |
---|
52 | 52 | | valorem taxation due to its location in this state for a temporary |
---|
53 | 53 | | period may be located in this state for the purpose of qualifying |
---|
54 | 54 | | for the tax exemption." |
