| 8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Article III, Texas Constitution, is amended by | |
| 10 | 10 | adding Section 48 to read as follows: | |
| 11 | 11 | Sec. 48. (a) In this section, "cannabis" means the plant | |
| 12 | 12 | Cannabis sativa L., whether growing or not, the seeds of that plant, | |
| 13 | 13 | and every compound, manufacture, salt, derivative, mixture, or | |
| 14 | 14 | preparation of that plant or its seeds. | |
| 15 | 15 | (b) The legislature by law shall authorize and regulate the | |
| 16 | 16 | possession, cultivation, and sale of cannabis for medical use in | |
| 17 | 17 | this state. | |
| 18 | 18 | SECTION 2. This proposed constitutional amendment shall be | |
| 19 | 19 | submitted to the voters at an election to be held November 5, 2019. | |
| 20 | 20 | The ballot shall be printed to provide for voting for or against the | |
| 21 | 21 | proposition: "The constitutional amendment directing the | |
| 22 | 22 | legislature to authorize and regulate the possession, cultivation, | |
| 23 | 23 | and sale of cannabis for medical use." |
