44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 86th
66 Legislature, Regular Session, 2019, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 Senate Bill 12 (the contributions to and benefits under the
1010 Teacher Retirement System of Texas) to consider and take action
1111 on the following matters:
1212 (1) Senate Rule 12.03(4) is suspended to permit the
1313 committee to add text on a matter not included in either the house
1414 or senate version of the bill in proposed SECTION 3 of the bill,
1515 by amending Section 825.4035(a), Government Code, to read as
1616 follows:
1717 (a) This section:
1818 (1) except as provided by Subdivision (2), applies
1919 only to an employer that is a public school or regional education
2020 service center that [who] reports to the retirement system under
2121 Section 825.403 the employment of a member [for whom the employer
2222 is not making contributions to the federal Old-Age, Survivors,
2323 and Disability Insurance program]; and
2424 (2) does not apply to an employer that is an
2525 institution of higher education.
2626 Explanation: The change is necessary to require only
2727 employers that are public schools, other than institutions of
2828 higher education, and regional education service centers that
2929 report to the Teacher Retirement System of Texas the employment
3030 of a member of the retirement system to contribute to the
3131 retirement system the amounts prescribed by Section 825.4035,
3232 Government Code, regardless of whether the employers are making
3333 contributions to the federal Old-Age, Survivors, and Disability
3434 Insurance program for that member.
3535 (2) Senate Rule 12.03(4) is suspended to permit the
3636 committee to add text on a matter not included in either the house
3737 or senate version of the bill by adding the following proposed
3838 SECTION 2 to the bill, amending the heading to Section 825.4035,
3939 Government Code:
4040 SECTION 2. The heading to Section 825.4035, Government
4141 Code, is amended to read as follows:
4242 Sec. 825.4035. EMPLOYER CONTRIBUTIONS FOR CERTAIN
4343 EMPLOYED MEMBERS [FOR WHOM THE EMPLOYER IS NOT MAKING
4444 CONTRIBUTIONS TO THE FEDERAL OLD-AGE, SURVIVORS, AND DISABILITY
4545 INSURANCE PROGRAM].
4646 Explanation: The change is necessary to ensure the
4747 heading of Section 825.4035, Government Code, accurately
4848 describes the substance of that section, as amended.
4949 (3) Senate Rules 12.03(1) and (3) are suspended to permit
5050 the committee to change, alter, or amend text and to add text on a
5151 matter not in disagreement in proposed SECTION 6 of the bill, the
5252 effective date provision of the bill, to read as follows:
5353 SECTION 6. This Act takes effect immediately if it
5454 receives a vote of two-thirds of all the members elected to each
5555 house, as provided by Section 39, Article III, Texas
5656 Constitution. If this Act does not receive the vote necessary
5757 for immediate effect, this Act takes effect September 1, 2019.
5858 Explanation: This change is necessary to allow the bill
5959 to take effect immediately.
