4+ RESOLUTION
55 BE IT RESOLVED, BY THE Senate of the State of Texas, that
66 Senate Rule 12.03 and 12.04, be suspended in part as provided by
77 Senate Rule 12.08 to enable consideration of, and action on, the
88 following specific matters which may be contained in the
99 Conference Committee Report on Senate Bill 500.
1010 A. Suspend Senate Rule 12.04 (2) to allow the Conference
1111 Committee to change items of appropriation that are the same in
1212 both versions to read as follows:
1313 SECTION 2. APPROPRIATION REDUCTION: FACILITIES
1414 COMMISSION. The unencumbered appropriations from the general
1515 revenue fund to the Facilities Commission made by Chapter 605
1616 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
1717 (the General Appropriations Act), for use during the state fiscal
1818 biennium ending August 31, 2019, for lease payments are reduced
1919 by $22,589,128. The commission shall identify the strategies and
2020 objectives to which the reduction is to be allocated and the
2121 amount of the reduction for each of those strategies and
2222 objectives.
2323 B. Suspend Senate Rule 12.04 (5) to allow the Conference
2424 Committee to add an item of appropriation that is not in either

2929 SECTION 4. APPROPRIATION REDUCTION: OFFICE OF THE
3030 ATTORNEY GENERAL. (a) It is the intent of the legislature that
3131 the Texas Child Support Enforcement System 2.0 project be
3232 canceled as of the effective date of this Act.
3333 (b) The unencumbered appropriations from the general
3434 revenue fund to the Office of the Attorney General made by
3535 Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular
3636 Session, 2017 (the General Appropriations Act), for use during
3737 the state fiscal biennium ending August 31, 2019, for Strategy
3838 B.1.1., Child Support Enforcement, as listed in that Act, are
3939 reduced by $21,799,752, including $11,370,987 from the Child
4040 Support Retained Collection Account.
4141 C. Suspend Senate Rule 12.04 (5) to allow the Conference
4242 Committee to add an item of appropriation that is not in either
4343 version of the bill to read as follows;
4444 Suspend Senate Rule 12.03 (4) to allow the Conference Committee
4545 to add text on any matter which is not included in either the
4646 House or Senate version of the bill to read as follows:
4747 SECTION 6. TRUSTEED PROGRAMS WITHIN THE OFFICE OF THE
4848 GOVERNOR: SURGE OPERATIONS. (a) In addition to amounts
4949 previously appropriated for the state fiscal biennium ending
5050 August 31, 2019, $100,000,000 is appropriated from the economic
5151 stabilization fund to the Trusteed Programs Within the Office of
5252 the Governor for the two-year period beginning on the effective
5353 date of this Act for surge operations necessary to secure the
5454 border under Strategy B.1.3., Homeland Security, as listed in
5555 Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular
5656 Session, 2017 (the General Appropriations Act). Funds
5757 appropriated under this subsection may be allocated as
5858 authorized by Section 421.072, Government Code.
5959 (b) It is the intent of the legislature that the Trusteed
6060 Programs Within the Office of the Governor work with the United
6161 States Department of Homeland Security to secure full federal
6262 reimbursement for funds appropriated under Subsection (a) of
6363 this section, to be deposited to the credit of the economic
6464 stabilization fund as provided by Section 88 of this Act.
6565 D. Suspend Senate Rule 12.04 (5) to allow the Conference
6666 Committee to add an item of appropriation that is not in either
6767 version of the bill to read as follows;

7474 2019, $2,149,600 is appropriated from the economic stabilization
7575 fund to the Texas Historical Commission for the two-year period
7676 beginning on the effective date of this Act for capital projects
7777 at the National Museum of the Pacific War under Strategy A.1.4.,
7878 Historic Sites, as listed in Chapter 605 (S.B. 1), Acts of the
7979 85th Legislature, Regular Session, 2017 (the General
8080 Appropriations Act), including:
8181 (1) updates to the electrical, security, and
8282 heating, ventilation, and air conditioning systems;
8383 (2) projects to address accessibility issues;
8484 (3) exterior, roofing, and structural repairs to
8585 the Nimitz Barn maintenance area;
8686 (4) refurbishment of the Bush Gallery to address
8787 wear and tear from visitor volume; and
8888 (5) technology upgrades to exhibits in the Bush
8989 Gallery.
9090 E. Suspend Senate Rule 12.04 (5) to allow the Conference

226226 SECTION 18. DEPARTMENT OF STATE HEALTH SERVICES: TRAUMA
227227 CAPACITY AND RESPONSE INFRASTRUCTURE. (a) In addition to
228228 amounts previously appropriated for the state fiscal biennium
229229 ending August 31, 2019, $17,000,000 is appropriated from the
230230 economic stabilization fund to the Department of State Health
231231 Services for the two-year period beginning on the effective date
232232 of this Act for increasing trauma capacity and improving related
233233 trauma response infrastructure under Strategy B.2.1., EMS and
234234 Trauma Care Systems, as listed in Chapter 605 (S.B. 1), Acts of
235235 the 85th Legislature, Regular Session, 2017 (the General
236236 Appropriations Act).
237237 (b) Of the amount appropriated under Subsection (a) of
238238 this section, $2,000,000 may be used only to provide funding in
239239 accordance with Section 780.004, Health and Safety Code, to
240240 trauma service area regional advisory councils for improving
241241 emergency management services.
242242 (c) Of the amount appropriated under Subsection (a) of
243243 this section, $15,000,000 may be used only to provide funding in
244244 accordance with Section 780.004, Health and Safety Code, to
245245 hospitals that demonstrate regional need and the ability to
246246 efficiently and effectively increase trauma capacity and improve
247247 related trauma response infrastructure. The Department of State
248248 Health Services shall allocate:
249249 (1) at least 40 percent of that amount to provide
250250 funding to hospitals in the Rio Grande Valley, prioritizing, to
251251 the extent consistent with general law, primary teaching
252252 hospitals in that region with a general surgery residency program
253253 pursuing designation as a level I trauma facility; and
254254 (2) not more than 40 percent of that amount to
255255 provide funding to hospitals located in a region directly
256256 affected by Hurricane Harvey.
257257 (d) Any funding provided to an entity under Subsection
258258 (b) or (c) of this section that is not spent for the purpose for
259259 which the funding was provided must be returned to the state.
260260 (e) The unexpended balance of money allocated as provided
261261 by Subsection (b) or (c) of this section as of August 31, 2020, is
262262 appropriated to the Department of State Health Services for the
263263 state fiscal year ending August 31, 2021, for the purpose for
264264 which it was allocated.

283283 transfer the following amounts from Goal A, Medicaid Client
284284 Services, to the following strategies as listed in Chapter 605
285285 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
286286 (the General Appropriations Act):
287287 (1) $5,500,000 to Strategy D.2.3., Community Mental
288288 Health Crisis Services; and
289289 (2) $2,000,000 to Strategy D.2.2., Community Mental
290290 Health Services - Children.
291291 O. Suspend Senate Rule 12.04 (3) to allow the Conference
292292 Committee to exceed the highest or be less than the lowest of
293293 items of appropriation that are contained in the House and Senate
294294 versions of the bill in different amounts to read as follows;

310310 non-maximum security unit at Rusk State Hospital;
311311 (2) $165,000,000 to begin construction of a 240-bed
312312 replacement campus of Austin State Hospital; and
313313 (3) $190,300,000 to begin construction of a 300-bed
314314 replacement campus of San Antonio State Hospital.

316316 Committee to exceed the amount of an item of appropriation

318318 SECTION 28. HEALTH AND HUMAN SERVICES COMMISSION: STATE

322322 to the Health and Human Services Commission for the state fiscal

349349 (a) The unencumbered appropriations from the Foundation School
350350 Fund, general revenue account number 0193, to the Texas Education
351351 Agency made by Chapter 605 (S.B. 1), Acts of the 85th
352352 Legislature, Regular Session, 2017 (the General Appropriations
353353 Act), for use during the state fiscal biennium ending August 31,
354354 2019, for Strategy A.1.1., FSP - Equalized Operations, as listed
355355 in that Act, are reduced by $903,300,000.
356356 (b) Notwithstanding Rider 3, page III-5, Chapter 605
357357 (S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
358358 (the General Appropriations Act), to the bill pattern of the
359359 appropriations to the Texas Education Agency, the sum-certain
360360 appropriation to the Foundation School Program for the state
361361 fiscal year ending August 31, 2019, is $21,495,735,602.
362362 S. Suspend Senate Rule 12.04 (5) to allow the Conference
363363 Committee to add an item of appropriation that is not in either
364364 version of the bill to read as follows;
365365 Suspend Senate Rule 12.03 (4) to allow the Conference Committee

368368 SECTION 31. TEXAS EDUCATION AGENCY: SPECIAL EDUCATION
369369 SUPPORTS AND MAINTENANCE OF STATE FINANCIAL SUPPORT FOR SPECIAL
370370 EDUCATION. (a) In addition to amounts previously appropriated
371371 for the state fiscal biennium ending August 31, 2019, the
372372 following amounts are appropriated from the economic
373- stabilization fund to the Texas Education Agency for the two-year
374- period beginning on the effective date of this Act for the
373+ stabilization fund to the Texas Education Agency for the two-
374+ year period beginning on the effective date of this Act for the
375375 following purposes:
376376 (1) $33,302,428 to offset federal funds withheld or
377377 expected to be withheld as a result of a failure to maintain state
378378 financial support for special education under 20 U.S.C. Section
379379 1412(a)(18) during the state fiscal year ending August 31, 2012;
380380 (2) $74,626,551 to negotiate a settlement agreement
381381 with the federal government to prevent the withholding of federal
382382 funds as a result of a failure to maintain state financial
383383 support for special education under 20 U.S.C. Section
384384 1412(a)(18) during the state fiscal years ending August 31, 2017
385385 (estimated to be $41,594,326), and August 31, 2018 (estimated to
386386 be $33,032,225); and
387387 (3) $111,625,833 for the following strategies as
388388 listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature,
389389 Regular Session, 2017 (the General Appropriations Act), to
390390 prevent a failure to maintain state financial support for special
391391 education under 20 U.S.C. Section 1412(a)(18) during the state
392392 fiscal year ending August 31, 2019:
393393 (A) $50,000,000 for Strategy A.2.3., Students
394394 with Disabilities, for grants to reimburse school districts for:
395395 (i) providing extended school year
396396 services to students enrolled in a special education program
397397 under Subchapter A, Chapter 29, Education Code;
398398 (ii) costs related to identification of
399399 students eligible to participate in a school district's special
400400 education program under Section 29.003, Education Code,
401401 including full individual and initial evaluations and
402402 independent education evaluations; and
403403 (iii) compensatory services costs
404404 related to the provision of services to students under the
405405 Individuals with Disabilities Education Act (20 U.S.C. Section
406406 1400 et seq.);
407407 (B) $478,500 for information technology needs
408408 related to special education supports under Strategy B.3.5.,
409409 Information Systems - Technology; and
410410 (C) $61,147,333 for special education funding
411411 under Strategy A.1.1., FSP - Equalized Operations.
412412 (b) The amount appropriated under Subsection (a)(1) of
413413 this section must be used in the same manner and for the same
414414 purposes as the withheld federal funds would have been provided.
415415 (c) The amounts appropriated under Subsections (a)(2)
416416 and (3)(C) of this section must be used to provide funding for
417417 public schools under Strategy A.1.1., FSP - Equalized
418418 Operations, as listed in Chapter 605 (S.B. 1), Acts of the 85th
419419 Legislature, Regular Session, 2017 (the General Appropriations
420420 Act), to be distributed for each full-time equivalent student in
421421 average daily attendance in a special education program under

941941 Session, 2019, relating to flood control planning and the funding
942942 of flood planning, mitigation, and infrastructure projects

974974 infrastructure fund.

983983 (1) the agency or institution shall reimburse the
984984 state in an amount equal to the lesser of the amount appropriated
985985 under this Act and spent for that expenditure or the amount
986986 reimbursed by the other source for that expenditure; and
987987 (2) the comptroller of public accounts shall
988988 deposit the amount of the reimbursement to the credit of the
989989 economic stabilization fund.
