5	5		BE IT RESOLVED, BY THE Senate of the State of Texas, that
6	6		Senate Rule 12.03 and 12.04, be suspended in part as provided by
7	7		Senate Rule 12.08 to enable consideration of, and action on, the
8	8		following specific matters which may be contained in the
9	9		Conference Committee Report on Senate Bill 500.
10	10		A. Suspend Senate Rule 12.04 (2) to allow the Conference
11	11		Committee to change items of appropriation that are the same in
12	12		both versions to read as follows:
13	13		SECTION 2. APPROPRIATION REDUCTION: FACILITIES
14	14		COMMISSION. The unencumbered appropriations from the general
15	15		revenue fund to the Facilities Commission made by Chapter 605
16	16		(S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
17	17		(the General Appropriations Act), for use during the state fiscal
18	18		biennium ending August 31, 2019, for lease payments are reduced
19	19		by $22,589,128. The commission shall identify the strategies and
20	20		objectives to which the reduction is to be allocated and the
21	21		amount of the reduction for each of those strategies and
22	22		objectives.
23	23		B. Suspend Senate Rule 12.04 (5) to allow the Conference
24	24		Committee to add an item of appropriation that is not in either
25	25		version of the bill to read as follows;
26	26		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
27	27		to add text on any matter which is not included in either the
28	28		House or Senate version of the bill to read as follows:
29	29		SECTION 4. APPROPRIATION REDUCTION: OFFICE OF THE
30	30		ATTORNEY GENERAL. (a) It is the intent of the legislature that
31	31		the Texas Child Support Enforcement System 2.0 project be
32	32		canceled as of the effective date of this Act.
33	33		(b) The unencumbered appropriations from the general
34	34		revenue fund to the Office of the Attorney General made by
35	35		Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular
36	36		Session, 2017 (the General Appropriations Act), for use during
37	37		the state fiscal biennium ending August 31, 2019, for Strategy
38	38		B.1.1., Child Support Enforcement, as listed in that Act, are
39	39		reduced by $21,799,752, including $11,370,987 from the Child
40	40		Support Retained Collection Account.
41	41		C. Suspend Senate Rule 12.04 (5) to allow the Conference
42	42		Committee to add an item of appropriation that is not in either
43	43		version of the bill to read as follows;
44	44		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
45	45		to add text on any matter which is not included in either the
46	46		House or Senate version of the bill to read as follows:
47	47		SECTION 6. TRUSTEED PROGRAMS WITHIN THE OFFICE OF THE
48	48		GOVERNOR: SURGE OPERATIONS. (a) In addition to amounts
49	49		previously appropriated for the state fiscal biennium ending
50	50		August 31, 2019, $100,000,000 is appropriated from the economic
51	51		stabilization fund to the Trusteed Programs Within the Office of
52	52		the Governor for the two-year period beginning on the effective
53	53		date of this Act for surge operations necessary to secure the
54	54		border under Strategy B.1.3., Homeland Security, as listed in
55	55		Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular
56	56		Session, 2017 (the General Appropriations Act). Funds
57	57		appropriated under this subsection may be allocated as
58	58		authorized by Section 421.072, Government Code.
59	59		(b) It is the intent of the legislature that the Trusteed
60	60		Programs Within the Office of the Governor work with the United
61	61		States Department of Homeland Security to secure full federal
62	62		reimbursement for funds appropriated under Subsection (a) of
63	63		this section, to be deposited to the credit of the economic
64	64		stabilization fund as provided by Section 88 of this Act.
65	65		D. Suspend Senate Rule 12.04 (5) to allow the Conference
66	66		Committee to add an item of appropriation that is not in either
67	67		version of the bill to read as follows;
68	68		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
69	69		to add text on any matter which is not included in either the
70	70		House or Senate version of the bill to read as follows:
71	71		SECTION 8. TEXAS HISTORICAL COMMISSION: NATIONAL MUSEUM
72	72		OF THE PACIFIC WAR. In addition to amounts previously
73	73		appropriated for the state fiscal biennium ending August 31,
74	74		2019, $2,149,600 is appropriated from the economic stabilization
75	75		fund to the Texas Historical Commission for the two-year period
76	76		beginning on the effective date of this Act for capital projects
77	77		at the National Museum of the Pacific War under Strategy A.1.4.,
78	78		Historic Sites, as listed in Chapter 605 (S.B. 1), Acts of the
79	79		85th Legislature, Regular Session, 2017 (the General
80	80		Appropriations Act), including:
81	81		(1) updates to the electrical, security, and
82	82		heating, ventilation, and air conditioning systems;
83	83		(2) projects to address accessibility issues;
84	84		(3) exterior, roofing, and structural repairs to
85	85		the Nimitz Barn maintenance area;
86	86		(4) refurbishment of the Bush Gallery to address
87	87		wear and tear from visitor volume; and
88	88		(5) technology upgrades to exhibits in the Bush
89	89		Gallery.
90	90		E. Suspend Senate Rule 12.04 (5) to allow the Conference
91	91		Committee to add an item of appropriation that is not in either
92	92		version of the bill to read as follows;
93	93		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
94	94		to add text on any matter which is not included in either the
95	95		House or Senate version of the bill to read as follows:
96	96		SECTION 9. TEXAS HISTORICAL COMMISSION: COURTHOUSE
97	97		PRESERVATION GRANTS. In addition to amounts previously
98	98		appropriated for the state fiscal biennium ending August 31,
99	99		2019, $25,000,000 is appropriated from the economic
100	100		stabilization fund to the Texas Historical Commission for the
101	101		two-year period beginning on the effective date of this Act for
102	102		courthouse preservation grants under Strategy A.1.3., Courthouse
103	103		Preservation, as listed in Chapter 605 (S.B. 1), Acts of the 85th
104	104		Legislature, Regular Session, 2017 (the General Appropriations
105	105		Act).
106	106		F. Suspend Senate Rule 12.04 (5) to allow the Conference
107	107		Committee to add an item of appropriation that is not in either
108	108		version of the bill to read as follows;
109	109		Suspend Senate Rule 12.03 (4) to allow the Conference Committee

112	112		SECTION 10. TEXAS HISTORICAL COMMISSION: DEFERRED
113	113		MAINTENANCE. In addition to amounts previously appropriated for
114	114		the state fiscal biennium ending August 31, 2019, and in addition
115	115		to other amounts appropriated by this Act, the following amounts
116	116		are appropriated from the economic stabilization fund to the
117	117		Texas Historical Commission for the two-year period beginning on
118	118		the effective date of this Act for the following strategies as
119	119		listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature,
120	120		Regular Session, 2017 (the General Appropriations Act), for
121	121		deferred maintenance projects:
122	122		(1) $300,000 for Strategy A.1.1., Architectural
123	123		Assistance; and
124	124		(2) $2,586,250 for Strategy A.1.4., Historic Sites.
125	125		G. Suspend Senate Rule 12.04 (5) to allow the Conference
126	126		Committee to add an item of appropriation that is not in either
127	127		version of the bill to read as follows;
128	128		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
129	129		to add text on any matter which is not included in either the

131	131		SECTION 11. TEXAS HISTORICAL COMMISSION: LEVI JORDAN

134	134		to other amounts appropriated by this Act, $2,000,000 is
135	135		appropriated from the economic stabilization fund to the Texas
136	136		Historical Commission for the two-year period beginning on the
137	137		effective date of this Act for historic site planning at the Levi
138	138		Jordan Plantation, including architectural, engineering,
139	139		interpretive, and site survey services and collections
140	140		conservation and acquisition to develop museum exhibits, under
141	141		Strategy A.1.4., Historic Sites, as listed in Chapter 605 (S.B.
142	142		1), Acts of the 85th Legislature, Regular Session, 2017 (the
143	143		General Appropriations Act).

187	187		Abuse Purchased Services; and
188	188		(3) $5,792,750 for Strategy B.1.8., Other CPS

193	193		SECTION 16. DEPARTMENT OF STATE HEALTH SERVICES: X-ALD
194	194		NEWBORN SCREENING. In addition to amounts previously
195	195		appropriated for the state fiscal biennium ending August 31,
196	196		2019, $7,927,458 is appropriated from the general revenue fund to
197	197		the Department of State Health Services for the two-year period
198	198		beginning on the effective date of this Act for screening
199	199		newborns for X-linked adrenoleukodystrophy (X-ALD) under
200	200		Strategy A.4.1., Laboratory Services, as listed in Chapter 605
201	201		(S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
202	202		(the General Appropriations Act).
203	203		L. Suspend Senate Rule 12.04 (5) to allow the Conference
204	204		Committee to add an item of appropriation that is not in either

209	209		SECTION 17. DEPARTMENT OF STATE HEALTH SERVICES:
210	210		EMERGENCY GENERATOR. In addition to amounts previously
211	211		appropriated for the state fiscal biennium ending August 31,
212	212		2019, $12,000,000 is appropriated from the economic
213	213		stabilization fund to the Department of State Health Services for
214	214		the two-year period beginning on the effective date of this Act
215	215		for an emergency generator for the Austin laboratory to continue
216	216		laboratory functions during a power outage under Strategy
217	217		A.4.1., Laboratory Services, as listed in Chapter 605 (S.B. 1),
218	218		Acts of the 85th Legislature, Regular Session, 2017 (the General
219	219		Appropriations Act).
220	220		M. Suspend Senate Rule 12.04 (2) to allow the Conference
221	221		Committee to change items of appropriation that are the same in
222	222		both versions to read as follows;
223	223		Suspend Senate Rule 12.03 (4) to allow the Conference Committee

226	226		SECTION 18. DEPARTMENT OF STATE HEALTH SERVICES: TRAUMA
227	227		CAPACITY AND RESPONSE INFRASTRUCTURE. (a) In addition to
228	228		amounts previously appropriated for the state fiscal biennium
229	229		ending August 31, 2019, $17,000,000 is appropriated from the
230	230		economic stabilization fund to the Department of State Health
231	231		Services for the two-year period beginning on the effective date
232	232		of this Act for increasing trauma capacity and improving related
233	233		trauma response infrastructure under Strategy B.2.1., EMS and
234	234		Trauma Care Systems, as listed in Chapter 605 (S.B. 1), Acts of
235	235		the 85th Legislature, Regular Session, 2017 (the General
236	236		Appropriations Act).
237	237		(b) Of the amount appropriated under Subsection (a) of
238	238		this section, $2,000,000 may be used only to provide funding in
239	239		accordance with Section 780.004, Health and Safety Code, to
240	240		trauma service area regional advisory councils for improving
241	241		emergency management services.
242	242		(c) Of the amount appropriated under Subsection (a) of
243	243		this section, $15,000,000 may be used only to provide funding in
244	244		accordance with Section 780.004, Health and Safety Code, to
245	245		hospitals that demonstrate regional need and the ability to
246	246		efficiently and effectively increase trauma capacity and improve
247	247		related trauma response infrastructure. The Department of State
248	248		Health Services shall allocate:
249	249		(1) at least 40 percent of that amount to provide
250	250		funding to hospitals in the Rio Grande Valley, prioritizing, to
251	251		the extent consistent with general law, primary teaching
252	252		hospitals in that region with a general surgery residency program
253	253		pursuing designation as a level I trauma facility; and
254	254		(2) not more than 40 percent of that amount to
255	255		provide funding to hospitals located in a region directly
256	256		affected by Hurricane Harvey.
257	257		(d) Any funding provided to an entity under Subsection
258	258		(b) or (c) of this section that is not spent for the purpose for
259	259		which the funding was provided must be returned to the state.
260	260		(e) The unexpended balance of money allocated as provided
261	261		by Subsection (b) or (c) of this section as of August 31, 2020, is
262	262		appropriated to the Department of State Health Services for the
263	263		state fiscal year ending August 31, 2021, for the purpose for
264	264		which it was allocated.
265	265		N. Suspend Senate Rule 12.04 (2) to allow the Conference
266	266		Committee to change items of appropriation that are the same in
267	267		both versions to read as follows;
268	268		Suspend Senate Rule 12.03 (4) to allow the Conference Committee

271	271		SECTION 19. HEALTH AND HUMAN SERVICES COMMISSION:
272	272		MEDICAID SHORTFALL. (a) In addition to amounts previously
273	273		appropriated for the state fiscal biennium ending August 31,
274	274		2019, $2,000,000,000 is appropriated from the general revenue
275	275		fund, and $2,150,000,000 is appropriated from federal funds, to
276	276		the Health and Human Services Commission for the state fiscal
277	277		year ending August 31, 2019, for Medicaid client services under
278	278		Goal A, Medicaid Client Services, as listed in Chapter 605 (S.B.
279	279		1), Acts of the 85th Legislature, Regular Session, 2017 (the
280	280		General Appropriations Act).
281	281		(b) Of the amounts appropriated under Subsection (a) of
282	282		this section, the Health and Human Services Commission shall
283	283		transfer the following amounts from Goal A, Medicaid Client
284	284		Services, to the following strategies as listed in Chapter 605
285	285		(S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
286	286		(the General Appropriations Act):
287	287		(1) $5,500,000 to Strategy D.2.3., Community Mental
288	288		Health Crisis Services; and
289	289		(2) $2,000,000 to Strategy D.2.2., Community Mental
290	290		Health Services - Children.
291	291		O. Suspend Senate Rule 12.04 (3) to allow the Conference
292	292		Committee to exceed the highest or be less than the lowest of
293	293		items of appropriation that are contained in the House and Senate
294	294		versions of the bill in different amounts to read as follows;
295	295		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
296	296		to add text on any matter which is not included in either the
297	297		House or Senate version of the bill to read as follows:
298	298		SECTION 22. HEALTH AND HUMAN SERVICES COMMISSION: STATE
299	299		HOSPITAL CONSTRUCTION. In addition to amounts previously
300	300		appropriated for the state fiscal biennium ending August 31,
301	301		2019, $445,354,363 is appropriated from the economic
302	302		stabilization fund to the Health and Human Services Commission
303	303		for the two-year period beginning on the effective date of this
304	304		Act for continuing improvements to state hospital facilities
305	305		under Strategy G.4.2., Facility Capital Repairs and Renovations,
306	306		as listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature,
307	307		Regular Session, 2017 (the General Appropriations Act), as
308	308		follows:
309	309		(1) $90,054,363 for construction of a 100-bed
310	310		non-maximum security unit at Rusk State Hospital;
311	311		(2) $165,000,000 to begin construction of a 240-bed
312	312		replacement campus of Austin State Hospital; and
313	313		(3) $190,300,000 to begin construction of a 300-bed
314	314		replacement campus of San Antonio State Hospital.
315	315		P. Suspend Senate Rule 12.04 (4) to allow the Conference
316	316		Committee to exceed the amount of an item of appropriation
317	317		contained in one version of the bill to read as follows:
318	318		SECTION 28. HEALTH AND HUMAN SERVICES COMMISSION: STATE
319	319		SUPPORTED LIVING CENTERS. In addition to amounts previously
320	320		appropriated for the state fiscal biennium ending August 31,
321	321		2019, $10,100,000 is appropriated from the general revenue fund
322	322		to the Health and Human Services Commission for the state fiscal
323	323		year ending August 31, 2019, for state supported living centers
324	324		under Strategy G.1.1., State Supported Living Centers, as listed
325	325		in Chapter 605 (S.B. 1), Acts of the 85th Legislature, Regular
326	326		Session, 2017 (the General Appropriations Act).
327	327		Q. Suspend Senate Rule 12.03 (4) to allow the Conference
328	328		Committee to add text on any matter which is not included in
329	329		either the House or Senate version of the bill to read as follows:
330	330		SECTION 29. HEALTH AND HUMAN SERVICES COMMISSION:
331	331		REPURPOSE OF EXPENDITURE OF FUNDS. Notwithstanding Section 20 of
332	332		the Special Provisions Relating to All Health and Human Services
333	333		Agencies, page II-124, Chapter 605 (S.B. 1), Acts of the 85th
334	334		Legislature, Regular Session, 2017 (the General Appropriations
335	335		Act), the Health and Human Services Commission may use
336	336		$63,832,747 of the amount appropriated under that Act to the
337	337		commission for Goal A, Medicaid Client Services, as listed in
338	338		that Act and designated under that rider for use only for the
339	339		health insurance providers fee, for Medicaid client services.
340	340		R. Suspend Senate Rule 12.04 (3) to allow the Conference
341	341		Committee to exceed the highest or be less than the lowest of
342	342		items of appropriation that are contained in the House and Senate
343	343		versions of the bill in different amounts to read as follows;
344	344		Suspend Senate Rule 12.03 (1) to allow the Conference Committee
345	345		to change, alter, or amend text which is not in disagreement to
346	346		read as follows:
347	347		SECTION 30. APPROPRIATION REDUCTION: TEXAS EDUCATION
348	348		AGENCY; SUM-CERTAIN APPROPRIATION FOR FOUNDATION SCHOOL PROGRAM.
349	349		(a) The unencumbered appropriations from the Foundation School
350	350		Fund, general revenue account number 0193, to the Texas Education
351	351		Agency made by Chapter 605 (S.B. 1), Acts of the 85th
352	352		Legislature, Regular Session, 2017 (the General Appropriations
353	353		Act), for use during the state fiscal biennium ending August 31,
354	354		2019, for Strategy A.1.1., FSP - Equalized Operations, as listed
355	355		in that Act, are reduced by $903,300,000.
356	356		(b) Notwithstanding Rider 3, page III-5, Chapter 605
357	357		(S.B. 1), Acts of the 85th Legislature, Regular Session, 2017
358	358		(the General Appropriations Act), to the bill pattern of the
359	359		appropriations to the Texas Education Agency, the sum-certain
360	360		appropriation to the Foundation School Program for the state
361	361		fiscal year ending August 31, 2019, is $21,495,735,602.
362	362		S. Suspend Senate Rule 12.04 (5) to allow the Conference
363	363		Committee to add an item of appropriation that is not in either
364	364		version of the bill to read as follows;
365	365		Suspend Senate Rule 12.03 (4) to allow the Conference Committee
366	366		to add text on any matter which is not included in either the
367	367		House or Senate version of the bill to read as follows:
368	368		SECTION 31. TEXAS EDUCATION AGENCY: SPECIAL EDUCATION
369	369		SUPPORTS AND MAINTENANCE OF STATE FINANCIAL SUPPORT FOR SPECIAL
370	370		EDUCATION. (a) In addition to amounts previously appropriated
371	371		for the state fiscal biennium ending August 31, 2019, the
372	372		following amounts are appropriated from the economic
373		-	stabilization fund to the Texas Education Agency for the two-~~year~~
374		-	period beginning on the effective date of this Act for the
	373	+	stabilization fund to the Texas Education Agency for the two-
	374	+	year period beginning on the effective date of this Act for the
375	375		following purposes:
376	376		(1) $33,302,428 to offset federal funds withheld or
377	377		expected to be withheld as a result of a failure to maintain state
378	378		financial support for special education under 20 U.S.C. Section
379	379		1412(a)(18) during the state fiscal year ending August 31, 2012;
380	380		(2) $74,626,551 to negotiate a settlement agreement
381	381		with the federal government to prevent the withholding of federal
382	382		funds as a result of a failure to maintain state financial
383	383		support for special education under 20 U.S.C. Section
384	384		1412(a)(18) during the state fiscal years ending August 31, 2017
385	385		(estimated to be $41,594,326), and August 31, 2018 (estimated to
386	386		be $33,032,225); and
387	387		(3) $111,625,833 for the following strategies as
388	388		listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature,
389	389		Regular Session, 2017 (the General Appropriations Act), to
390	390		prevent a failure to maintain state financial support for special
391	391		education under 20 U.S.C. Section 1412(a)(18) during the state
392	392		fiscal year ending August 31, 2019:
393	393		(A) $50,000,000 for Strategy A.2.3., Students
394	394		with Disabilities, for grants to reimburse school districts for:
395	395		(i) providing extended school year
396	396		services to students enrolled in a special education program
397	397		under Subchapter A, Chapter 29, Education Code;
398	398		(ii) costs related to identification of
399	399		students eligible to participate in a school district's special
400	400		education program under Section 29.003, Education Code,

412	412		(b) The amount appropriated under Subsection (a)(1) of
413	413		this section must be used in the same manner and for the same
414	414		purposes as the withheld federal funds would have been provided.
415	415		(c) The amounts appropriated under Subsections (a)(2)
416	416		and (3)(C) of this section must be used to provide funding for
417	417		public schools under Strategy A.1.1., FSP - Equalized
418	418		Operations, as listed in Chapter 605 (S.B. 1), Acts of the 85th
419	419		Legislature, Regular Session, 2017 (the General Appropriations
420	420		Act), to be distributed for each full-time equivalent student in
421	421		average daily attendance in a special education program under

830	830		(b) Contingent on Senate Bill No. 7 or similar
831	831		legislation of the 86th Legislature, Regular Session, 2019,
832	832		relating to flood control planning and the funding of flood
833	833		planning, mitigation, and infrastructure projects becoming law
834	834		and the constitutional amendment proposed by the 86th
835	835		Legislature, Regular Session, 2019, providing for the creation
836	836		of the flood infrastructure fund to assist in the financing of
837	837		drainage, flood mitigation, and flood control projects being
838	838		approved by the voters:
839	839		(1) the appropriation of money made in Subsection
840	840		(a) of this section has no effect; and
841	841		(2) in addition to amounts previously appropriated
842	842		for the state fiscal biennium ending August 31, 2019, and in
843	843		addition to other amounts appropriated by this Act, the following
844	844		amounts are appropriated from the flood infrastructure fund to
845	845		the Water Development Board for the two-year period beginning on
846	846		the effective date of this Act for the following strategies as
847	847		listed in Chapter 605 (S.B. 1), Acts of the 85th Legislature,
848	848		Regular Session, 2017 (the General Appropriations Act), for

862	862		the state fiscal year ending August 31, 2021, in addition to the
863	863		number of FTEs the board is authorized by other law to employ
864	864		during those state fiscal years to administer the project
865	865		funding.

867	867		Committee to add an item of appropriation that is not in either

951	951		least $47,000,000 to the credit of the floodplain management
952	952		account 0330 in the Texas infrastructure resiliency fund.

978	978		SECTION 88. REIMBURSEMENT TO ECONOMIC STABILIZATION
979	979		FUND. If any state agency or public institution of higher
980	980		education receives reimbursement from the federal government, an
981	981		insurer, or another source for an expenditure paid from money
982	982		appropriated by this Act:
983	983		(1) the agency or institution shall reimburse the
984	984		state in an amount equal to the lesser of the amount appropriated
985	985		under this Act and spent for that expenditure or the amount
986	986		reimbursed by the other source for that expenditure; and
987	987		(2) the comptroller of public accounts shall
988	988		deposit the amount of the reimbursement to the credit of the
989	989		economic stabilization fund.
