44 SENATE RESOLUTION
55 BE IT RESOLVED by the Senate of the State of Texas, 86th
66 Legislature, Regular Session, 2019, That Senate Rule 12.03 be
77 suspended in part as provided by Senate Rule 12.08 to enable the
88 conference committee appointed to resolve the differences on
99 House Bill 3284 (the prescribing and dispensing of controlled
1010 substances under the Texas Controlled Substances Act;
1111 authorizing a fee; providing for administrative penalties;
1212 creating criminal offenses) to consider and take action on the
1313 following matters:
1414 (1) Senate Rule 12.03(2) is suspended to permit the
1515 committee to omit text not in disagreement by omitting SECTION 1
1616 of the house engrossment of House Bill 3284 and the corresponding
1717 SECTION of the bill as the bill was amended by the senate adding
1818 Section 481.0755, Health and Safety Code, which reads as follows:
1919 SECTION 1. Subchapter C, Chapter 481, Health and Safety
2020 Code, is amended by adding Section 481.0755 to read as follows:
2121 Sec. 481.0755. WRITTEN, ORAL, AND TELEPHONICALLY
2222 COMMUNICATED PRESCRIPTIONS. (a) Notwithstanding Sections
2323 481.073, 481.074, and 481.075, a person prescribing or
2424 dispensing a controlled substance must use the electronic
2525 prescription record and may not use a written, oral, or
2626 telephonically communicated prescription.
2727 (b) A prescriber may issue a written, oral, or
2828 telephonically communicated prescription for a controlled
2929 substance as authorized under this subchapter only if the
3030 prescription is issued:
3131 (1) by a veterinarian;
3232 (2) in circumstances in which electronic
3333 prescribing is not available due to temporary technological or
3434 electronic failure, as prescribed by board rule;
3535 (3) by a practitioner to be dispensed by a pharmacy
3636 located outside this state, as prescribed by board rule;
3737 (4) when the prescriber and dispenser are the same
3838 entity;
3939 (5) in circumstances in which necessary elements
4040 are not supported by the most recent electronic prescription drug
4141 software;
4242 (6) for a drug for which the United States Food and
4343 Drug Administration requires additional information in the
4444 prescription that is not possible with electronic prescribing;
4545 (7) for a non-patient-specific prescription
4646 pursuant to a standing order, approved protocol for drug therapy,
4747 collaborative drug management, or comprehensive medication
4848 management, in response to a public health emergency or in other
4949 circumstances in which the practitioner may issue a
5050 non-patient-specific prescription;
5151 (8) for a drug under a research protocol;
5252 (9) by a prescriber who is employed by or is
5353 practicing a health care profession at a health-related
5454 institution, as defined by Section 62.161, Education Code, as
5555 added by Chapter 448 (H.B. 7), Acts of the 84th Legislature,
5656 2015;
5757 (10) by a practitioner who has received a waiver
5858 under Subsection (c) from the requirement to use electronic
5959 prescribing; or
6060 (11) under circumstances in which the practitioner
6161 has the present ability to submit an electronic prescription but
6262 reasonably determines that it would be impractical for the
6363 patient to obtain the drugs prescribed under the electronic
6464 prescription in a timely manner and that a delay would adversely
6565 impact the patient's medical condition.
6666 (c) The board shall adopt rules establishing a process by
6767 which a practitioner may request and receive a waiver under
6868 Subsection (b)(10), not to exceed one year, from the requirement
6969 to use electronic prescribing. The board shall adopt rules
7070 establishing the eligibility for a waiver, including:
7171 (1) economic hardship;
7272 (2) technological limitations not reasonably within
7373 the control of the practitioner; or
7474 (3) other exceptional circumstances demonstrated by
7575 the practitioner.
7676 (d) A written, oral, or telephonically communicated
7777 prescription must comply with the applicable requirements
7878 prescribed by Sections 481.074 and 481.075.
7979 (e) A dispensing pharmacist who receives a controlled
8080 substance prescription in a manner other than electronically is
8181 not required to verify that the prescription is exempt from the
8282 requirement that it be submitted electronically.
8383 (f) The board shall enforce this section.

9292 amended by the senate, to strike references to Section 481.0755,
9393 Health and Safety Code.
9494 Explanation: This change is necessary to conform
9595 cross-references to the omission of proposed Section 481.0755,
9696 Health and Safety Code.
9797 (3) Senate Rule 12.03(2) is suspended to permit the
9898 committee to omit text not in disagreement by omitting SECTION 13
9999 of the house engrossment of House Bill 3284 and the corresponding
100100 SECTION of the bill as the bill was amended by the senate, which
101101 reads as follows:
102102 SECTION 13. Section 481.0755, Health and Safety Code, as
103103 added by this Act, applies only to a prescription issued on or
104104 after the effective date of this Act.
105105 Explanation: This change is necessary to conform to the
106106 omission of proposed Section 481.0755, Health and Safety Code.
