55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the medical use of low-THC cannabis by certain patients
88 with post-traumatic stress disorder under the Texas Compassionate
99 Use Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 169.003, Occupations Code, is amended to
1212 read as follows:
1313 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A physician
1414 described by Section 169.002 may prescribe low-THC cannabis to a
1515 patient if:
1616 (1) the patient is a permanent resident of the state;
1717 (2) the physician complies with the registration
1818 requirements of Section 169.004; and
1919 (3) the physician certifies to the department that:
2020 (A) the patient is diagnosed with:
2121 (i) epilepsy;
2222 (ii) a seizure disorder;
2323 (iii) multiple sclerosis;
2424 (iv) spasticity;
2525 (v) amyotrophic lateral sclerosis;
2626 (vi) autism;
2727 (vii) terminal cancer; [or]
2828 (viii) an incurable neurodegenerative
2929 disease; or
3030 (ix) post-traumatic stress disorder; and
3131 (B) the physician determines the risk of the
3232 medical use of low-THC cannabis by the patient is reasonable in
3333 light of the potential benefit for the patient.
3434 SECTION 2. This Act takes effect September 1, 2021.
