10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 169.003, Occupations Code, is amended to | |
12 | 12 | read as follows: | |
13 | 13 | Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A physician | |
14 | 14 | described by Section 169.002 may prescribe low-THC cannabis to a | |
15 | 15 | patient if: | |
16 | 16 | (1) the patient is a permanent resident of the state; | |
17 | 17 | (2) the physician complies with the registration | |
18 | 18 | requirements of Section 169.004; and | |
19 | 19 | (3) the physician certifies to the department that: | |
20 | 20 | (A) the patient is diagnosed with: | |
21 | 21 | (i) epilepsy; | |
22 | 22 | (ii) a seizure disorder; | |
23 | 23 | (iii) multiple sclerosis; | |
24 | 24 | (iv) spasticity; | |
25 | 25 | (v) amyotrophic lateral sclerosis; | |
26 | 26 | (vi) autism; | |
27 | 27 | (vii) terminal cancer; [or] | |
28 | 28 | (viii) an incurable neurodegenerative | |
29 | 29 | disease; or | |
30 | 30 | (ix) post-traumatic stress disorder; and | |
31 | 31 | (B) the physician determines the risk of the | |
32 | 32 | medical use of low-THC cannabis by the patient is reasonable in | |
33 | 33 | light of the potential benefit for the patient. | |
34 | 34 | SECTION 2. This Act takes effect September 1, 2021. |
