| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 375, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 375.0635 to read as follows: |
|---|
| 12 | 12 | | Sec. 375.0635. DIRECTOR ELECTION. (a) Directors of a |
|---|
| 13 | 13 | | district created by commission order under Subchapter B, other than |
|---|
| 14 | 14 | | those appointed under Section 375.026 or 375.066, are elected as |
|---|
| 15 | 15 | | provided by Subchapter D, Chapter 49, Water Code. |
|---|
| 16 | 16 | | (b) Directors may be elected to serve successive terms. |
|---|
| 17 | 17 | | SECTION 2. The heading to Section 375.064, Local Government |
|---|
| 18 | 18 | | Code, is amended to read as follows: |
|---|
| 19 | 19 | | Sec. 375.064. RECOMMENDATIONS FOR SUCCEEDING BOARD OF |
|---|
| 20 | 20 | | DISTRICT CREATED BY SPECIAL LAW. |
|---|
| 21 | 21 | | SECTION 3. Section 375.064, Local Government Code, is |
|---|
| 22 | 22 | | amended by adding Subsection (f) to read as follows: |
|---|
| 23 | 23 | | (f) This section applies only to the appointment of |
|---|
| 24 | 24 | | directors of a district created by a special Act of the legislature |
|---|
| 25 | 25 | | that provides for succeeding directors to be appointed as provided |
|---|
| 26 | 26 | | by this section or subchapter. |
|---|
| 27 | 27 | | SECTION 4. Section 375.067(a), Local Government Code, is |
|---|
| 28 | 28 | | amended to read as follows: |
|---|
| 29 | 29 | | (a) As soon as practicable after a director is elected or |
|---|
| 30 | 30 | | appointed, the director shall execute a $10,000 bond payable to the |
|---|
| 31 | 31 | | district and conditioned on the faithful performance of the |
|---|
| 32 | 32 | | director's duties. |
|---|
| 33 | 33 | | SECTION 5. Section 375.068, Local Government Code, is |
|---|
| 34 | 34 | | amended to read as follows: |
|---|
| 35 | 35 | | Sec. 375.068. OFFICERS. After directors [are appointed |
|---|
| 36 | 36 | | and] have qualified by executing a bond and taking the oath, they |
|---|
| 37 | 37 | | shall organize by electing a president, a vice-president, a |
|---|
| 38 | 38 | | secretary, and any other officers the board considers necessary. |
|---|
| 39 | 39 | | SECTION 6. (a) Members of the board of directors of a |
|---|
| 40 | 40 | | municipal management district created by order of the Texas |
|---|
| 41 | 41 | | Commission on Environmental Quality shall be elected under Section |
|---|
| 42 | 42 | | 375.0635, Local Government Code, as added by this Act, beginning |
|---|
| 43 | 43 | | with the general election conducted in 2021 for terms beginning on |
|---|
| 44 | 44 | | or after January 1, 2022. |
|---|
| 45 | 45 | | (b) A member of the board of directors of a municipal |
|---|
| 46 | 46 | | management district created by order of the Texas Commission on |
|---|
| 47 | 47 | | Environmental Quality who is appointed under Section 375.064, Local |
|---|
| 48 | 48 | | Government Code, for a term beginning before January 1, 2022, shall |
|---|
| 49 | 49 | | continue to serve until the expiration of the member's term. |
|---|
| 50 | 50 | | SECTION 7. This Act takes effect September 1, 2021. |
