410 AN ACT
511 relating to the requisites of a bail bond given by certain
612 defendants and to conditions of release on bond for certain
713 defendants.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Chapter 17, Code of Criminal Procedure, is
1016 amended by adding Article 17.081 to read as follows:
1117 Art. 17.081. ADDITIONAL REQUISITES OF BAIL BOND GIVEN BY
1218 CERTAIN DEFENDANTS. In addition to the requirements of Article
1319 17.08, a bail bond for a defendant charged with an offense under
1420 Section 20A.02, 20A.03, 43.02, 43.03, 43.031, 43.04, 43.041, or
1521 43.05, Penal Code, must include the address, identification number,
1622 and state of issuance as shown on a valid driver's license or
1723 identification card for the defendant and any surety, including any
1824 agent executing the bail bond on behalf of a corporation acting as
1925 surety.
2026 SECTION 2. Article 17.41(a), Code of Criminal Procedure, is
2127 amended to read as follows:
2228 (a) This article applies to a defendant charged with an
2329 offense under any of the following provisions of the Penal Code, if
2430 committed against a child younger than 18 [14] years of age:
2531 (1) Chapter 20A (Trafficking of Persons), 21 (Sexual
2632 Offenses), [or] 22 (Assaultive Offenses), or 43 (Public Indecency);
2733 or
2834 (2) Section 25.02 (Prohibited Sexual Conduct) [; or
2935 [(3) Section 43.25 (Sexual Performance by a Child)].
3036 SECTION 3. Chapter 17, Code of Criminal Procedure, is
3137 amended by adding Article 17.465 to read as follows:
3238 Art. 17.465. CONDITIONS FOR DEFENDANT CHARGED WITH CERTAIN
3339 TRAFFICKING OR PROSTITUTION RELATED OFFENSES INVOLVING ADULT
3440 VICTIMS. (a) This article does not apply with respect to a
3541 defendant to whom Article 17.41 applies.
3642 (b) A magistrate shall require as a condition of release on
3743 bond that a defendant charged with an offense under Section 20A.02,
3844 20A.03, 43.03, 43.031, 43.04, 43.041, or 43.05, Penal Code,
3945 committed against a person 18 years of age or older may not:
4046 (1) communicate directly or indirectly with the
4147 victim; or
4248 (2) go to or near:
4349 (A) the residence, place of employment, or
4450 business of the victim; or
4551 (B) if applicable, a school, day-care facility,
4652 or similar facility where a dependent child of the victim is in
4753 attendance.
4854 (c) The magistrate shall specifically describe the
4955 prohibited locations under Subsection (b)(2) and the minimum
5056 distances, if any, that the defendant must maintain from the
5157 locations.
5258 (d) At a hearing limited to determining whether the
5359 defendant violated a condition of bond imposed under Subsection
5460 (b), the magistrate may revoke the defendant's bond only if the
5561 magistrate finds by a preponderance of the evidence that the
5662 violation occurred. If the magistrate finds that the violation
5763 occurred, the magistrate shall revoke the defendant's bond and
5864 order that the defendant be immediately returned to custody. Once
5965 the defendant is placed in custody, the revocation of the
6066 defendant's bond discharges the sureties on the bond, if any, from
6167 any future liability on the bond. A discharge under this subsection
6268 from any future liability on the bond does not discharge any surety
6369 from liability for previous forfeitures on the bond.
6470 SECTION 4. Article 17.081, Code of Criminal Procedure, as
6571 added by this Act, applies only to a bail bond that is executed on or
6672 after the effective date of this Act. A bail bond executed before
6773 the effective date of this Act is governed by the law in effect on
6874 the date the bail bond was executed, and the former law is continued
6975 in effect for that purpose.
7076 SECTION 5. Article 17.41(a), Code of Criminal Procedure, as
7177 amended by this Act, and Article 17.465, Code of Criminal
7278 Procedure, as added by this Act, apply only to a person who is
7379 arrested on or after the effective date of this Act. A person
7480 arrested before the effective date of this Act is governed by the
7581 law in effect on the date the person was arrested, and the former
7682 law is continued in effect for that purpose.
7783 SECTION 6. This Act takes effect September 1, 2021.
