| 10 | 10 | SECTION 1. Article 17.41(a), Code of Criminal Procedure, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) This article applies to a defendant charged with an | |
| 13 | 13 | offense under any of the following provisions of the Penal Code, if | |
| 14 | 14 | committed against a child younger than 18 [14] years of age: | |
| 15 | 15 | (1) Chapter 20A (Trafficking of Persons), 21 (Sexual | |
| 16 | 16 | Offenses), [or] 22 (Assaultive Offenses), or 43 (Public Indecency); | |
| 17 | 17 | or | |
| 18 | 18 | (2) Section 25.02 (Prohibited Sexual Conduct) [; or | |
| 19 | 19 | [(3) Section 43.25 (Sexual Performance by a Child)]. | |
| 20 | 20 | SECTION 2. The change in law made by this Act applies only | |
| 21 | 21 | to a person who is arrested on or after the effective date of this | |
| 22 | 22 | Act. A person arrested before the effective date of this Act is | |
| 23 | 23 | governed by the law in effect on the date the person was arrested, | |
| 24 | 24 | and the former law is continued in effect for that purpose. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
