9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 261.101, Family Code, is amended by | |
11 | 11 | adding Subsection (a-1) to read as follows: | |
12 | 12 | (a-1) A person shall immediately make a report as provided | |
13 | 13 | by this subchapter if the person knows that: | |
14 | 14 | (1) a child suffered a serious bodily injury, as | |
15 | 15 | defined by Section 1.07, Penal Code; and | |
16 | 16 | (2) the serious bodily injury was caused by abuse or | |
17 | 17 | neglect. | |
18 | 18 | SECTION 2. Section 261.109, Family Code, is amended by | |
19 | 19 | adding Subsections (a-2) and (b-1) to read as follows: | |
20 | 20 | (a-2) A person commits an offense if the person is required | |
21 | 21 | to make a report under Section 261.101(a-1) and knowingly fails to | |
22 | 22 | make a report as provided in this chapter. | |
23 | 23 | (b-1) An offense under Subsection (a-2) is a state jail | |
24 | 24 | felony unless it is shown on the trial of the offense that the child | |
25 | 25 | was younger than seven years of age and died as a result of the | |
26 | 26 | serious bodily injury, in which event the offense is a third degree | |
27 | 27 | felony. | |
28 | 28 | SECTION 3. This Act takes effect September 1, 2021. |
