55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reporting the serious bodily injury of a child;
88 providing a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 261.101, Family Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) A person shall immediately make a report as provided
1313 by this subchapter if the person knows that:
1414 (1) a child suffered a serious bodily injury, as
1515 defined by Section 1.07, Penal Code; and
1616 (2) the serious bodily injury was caused by abuse or
1717 neglect.
1818 SECTION 2. Section 261.109, Family Code, is amended by
1919 adding Subsections (a-2) and (b-1) to read as follows:
2020 (a-2) A person commits an offense if the person is required
2121 to make a report under Section 261.101(a-1) and knowingly fails to
2222 make a report as provided in this chapter.
2323 (b-1) An offense under Subsection (a-2) is a state jail
2424 felony unless it is shown on the trial of the offense that the child
2525 was younger than seven years of age and died as a result of the
2626 serious bodily injury, in which event the offense is a third degree
2727 felony.
2828 SECTION 3. This Act takes effect September 1, 2021.
