66 AN ACT
77 relating to adjustment of the average daily attendance for school
88 districts providing additional half-day instruction for certain
99 students.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 48.0051, Education Code, is amended by
1212 amending Subsection (a) and adding Subsection (a-2) to read as
1313 follows:
1414 (a) Subject to Subsection (a-1), the commissioner shall
1515 adjust the average daily attendance of a school district or
1616 open-enrollment charter school under Section 48.005 in the manner
1717 provided by Subsection (b) if the district or school:
1818 (1) provides the minimum number of minutes of
1919 operational and instructional time required under Section 25.081
2020 and commissioner rules adopted under that section over at least 180
2121 days of instruction as provided by Subsection (a-2); and
2222 (2) offers an additional 30 days of half-day
2323 instruction for students enrolled in prekindergarten through fifth
2424 grade.
2525 (a-2) To be eligible for the adjustment to the average daily
2626 attendance under Subsection (a), a school district or
2727 open-enrollment charter school is only required to provide the
2828 minimum number of minutes of operational and instructional time
2929 described by Subsection (a)(1) over at least 180 days of
3030 instruction for students to whom the district or school offers the
3131 additional 30 days of half-day instruction.
3232 SECTION 2. This Act takes effect September 1, 2021.
