| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 48.0051, Education Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (a) and adding Subsection (a-2) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) Subject to Subsection (a-1), the commissioner shall |
|---|
| 15 | 15 | | adjust the average daily attendance of a school district or |
|---|
| 16 | 16 | | open-enrollment charter school under Section 48.005 in the manner |
|---|
| 17 | 17 | | provided by Subsection (b) if the district or school: |
|---|
| 18 | 18 | | (1) provides the minimum number of minutes of |
|---|
| 19 | 19 | | operational and instructional time required under Section 25.081 |
|---|
| 20 | 20 | | and commissioner rules adopted under that section over at least 180 |
|---|
| 21 | 21 | | days of instruction as provided by Subsection (a-2); and |
|---|
| 22 | 22 | | (2) offers an additional 30 days of half-day |
|---|
| 23 | 23 | | instruction for students enrolled in prekindergarten through fifth |
|---|
| 24 | 24 | | grade. |

| 25 | 25 | | (a-2) To be eligible for the adjustment to the average daily |
|---|
| 26 | 26 | | attendance under Subsection (a), a school district or |
|---|
| 27 | 27 | | open-enrollment charter school is only required to provide the |
|---|
| 28 | 28 | | minimum number of minutes of operational and instructional time |
|---|
| 29 | 29 | | described by Subsection (a)(1) over at least 180 days of |
|---|
| 30 | 30 | | instruction for students to whom the district or school offers the |
|---|
| 31 | 31 | | additional 30 days of half-day instruction. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2021. |
