4	11		AN ACT
5	12		relating to the performance of pest control work by persons who hold
6	13		a commercial or noncommercial applicator license issued by the
7	14		Department of Agriculture.
8	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	16		SECTION 1. Section 1951.053(a), Occupations Code, is
10	17		amended to read as follows:
11	18		(a) Except as provided by Sections 1951.212 and
12	19		1951.457(c), this chapter does not apply to:
13	20		(1) a person who performs pest control work on growing
14	21		plants, trees, shrubs, grass, or other horticultural plants if the
15	22		person holds a commercial or noncommercial applicator license from
16	23		the department and issued under Chapter 76, Agriculture Code, that
17	24		covers the pest control work or is under the direct supervision of a
18	25		person who holds a commercial or noncommercial applicator license
19	26		from the department and issued under Chapter 76, Agriculture Code,
20	27		that covers pest control work; or
21	28		(2) a person who performs pest control work on growing
22	29		plants, trees, shrubs, grass, or other horticultural plants or
23	30		rights-of-way if the person:
24	31		(A) is employed by a political subdivision or a
25	32		cemetery;
26	33		(B) is engaged in pest control work or vegetation
27	34		management for the political subdivision or cemetery;
28	35		(C) holds a commercial or noncommercial
29	36		applicator license from the department and issued under Chapter 76,
30	37		Agriculture Code, that covers pest control work or is under the
31	38		direct supervision of a person who holds a commercial or
32	39		noncommercial applicator license from the department and issued
33	40		under Chapter 76, Agriculture Code, that covers pest control work;
34	41		and
35	42		(D) complies with annual continuing education
36	43		required by the department.
37	44		SECTION 2. This Act takes effect immediately if it receives
38	45		a vote of two-thirds of all the members elected to each house, as
39	46		provided by Section 39, Article III, Texas Constitution. If this
40	47		Act does not receive the vote necessary for immediate effect, this
41	48		Act takes effect September 1, 2021.
