9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 85, Family Code, is | |
11 | 11 | amended by adding Section 85.0641 to read as follows: | |
12 | 12 | Sec. 85.0641. MANDATORY TRANSFER OF CERTAIN PROTECTIVE | |
13 | 13 | ORDERS. (a) This section applies only in a county with a population | |
14 | 14 | of four million or more. | |
15 | 15 | (b) Notwithstanding Section 85.064(a), during the pendency | |
16 | 16 | of a suit affecting the parent-child relationship, a court that | |
17 | 17 | renders a protective order that affects the right of a party to the | |
18 | 18 | suit to possession of or access to a child shall transfer the | |
19 | 19 | protection order to the court having jurisdiction of the suit | |
20 | 20 | affecting the parent-child relationship. | |
21 | 21 | SECTION 2. Section 85.0641, Family Code, as added by this | |
22 | 22 | Act, applies only to a protective order rendered on or after the | |
23 | 23 | effective date of this Act. A protective order rendered before that | |
24 | 24 | date is governed by the law in effect on the date the order was | |
25 | 25 | rendered, and the former law is continued in effect for that | |
26 | 26 | purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
