7 | 7 | | relating to the inclusion of a nonprofit attraction on a specific |
---|
8 | 8 | | information logo sign. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 391.001, Transportation Code, is amended |
---|
11 | 11 | | by adding Subdivision (10) and amending Subdivision (12) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (10) "Nonprofit attraction" means an establishment, |
---|
14 | 14 | | including a museum, monument, or park, that: |
---|
15 | 15 | | (A) is exempt from income taxation under Section |
---|
16 | 16 | | 501(a), Internal Revenue Code of 1986, by being listed under |
---|
17 | 17 | | Section 501(c)(3) of that code; and |
---|
18 | 18 | | (B) meets the criteria established by the |
---|
19 | 19 | | department by rule under Section 391.093(i). |
---|
20 | 20 | | (12) "Specific information logo sign" means a |
---|
21 | 21 | | rectangular sign imprinted with: |
---|
22 | 22 | | (A) the words "GAS," "FOOD," "LODGING," |
---|
23 | 23 | | "CAMPING," [or] "24 HOUR Rx," or "ATTRACTION" or with a combination |
---|
24 | 24 | | of those words;[,] and |
---|
25 | 25 | | (B) the specific brand names of commercial |
---|
26 | 26 | | establishments offering those services or names of nonprofit |
---|
27 | 27 | | attractions, as applicable. |
---|
28 | 28 | | SECTION 2. Section 391.091(b-1), Transportation Code, is |
---|
29 | 29 | | amended to read as follows: |
---|
30 | 30 | | (b-1) A contract under this section shall provide for: |
---|
31 | 31 | | (1) the assessment of fees to be paid to a contractor |
---|
32 | 32 | | by a commercial establishment or nonprofit attraction eligible for |
---|
33 | 33 | | display on the specific information logo sign; and |
---|
34 | 34 | | (2) remittance to the department of at least 10 |
---|
35 | 35 | | percent of the fees collected by the contractor. |
---|
36 | 36 | | SECTION 3. Section 391.093, Transportation Code, is amended |
---|
37 | 37 | | by amending Subsection (a) and adding Subsections (a-1), (a-2), and |
---|
38 | 38 | | (i) to read as follows: |
---|
39 | 39 | | (a) A commercial establishment, to be eligible to have its |
---|
40 | 40 | | name displayed on a specific information logo sign, must: |
---|
41 | 41 | | (1) provide gas, food, lodging, camping, or pharmacy |
---|
42 | 42 | | services; and |
---|
43 | 43 | | (2) be located not more than three miles from an |
---|
44 | 44 | | interchange on an eligible highway. |
---|
45 | 45 | | (a-1) A nonprofit attraction, to be eligible to have its |
---|
46 | 46 | | name displayed on a specific information logo sign, must be located |
---|
47 | 47 | | not more than three miles from an interchange on an eligible |
---|
48 | 48 | | highway. |
---|
49 | 49 | | (a-2) If no commercial establishment or nonprofit |
---|
50 | 50 | | attraction [service] participating or willing to participate in the |
---|
51 | 51 | | specific information logo sign program is located within three |
---|
52 | 52 | | miles of an interchange, the commission may grant permits for |
---|
53 | 53 | | commercial establishments and nonprofit attractions located not |
---|
54 | 54 | | farther than: |
---|
55 | 55 | | (1) six miles from the interchange; |
---|
56 | 56 | | (2) nine miles from the interchange if no |
---|
57 | 57 | | establishment or attraction [service] participating or willing to |
---|
58 | 58 | | participate in the program is located within six miles from the |
---|
59 | 59 | | interchange; |
---|
60 | 60 | | (3) 12 miles from the interchange if no establishment |
---|
61 | 61 | | or attraction [service] participating or willing to participate in |
---|
62 | 62 | | the program is located within nine miles of the interchange; or |
---|
63 | 63 | | (4) 15 miles from the interchange if no establishment |
---|
64 | 64 | | or attraction [service] participating or willing to participate in |
---|
65 | 65 | | the program is located within 12 miles of the interchange. |
---|
66 | 66 | | (i) The department by rule shall establish criteria for |
---|
67 | 67 | | establishments that are eligible for inclusion as nonprofit |
---|
68 | 68 | | attractions on specific information logo signs. |
---|
69 | 69 | | SECTION 4. Sections 391.094 and 391.095, Transportation |
---|
70 | 70 | | Code, are amended to read as follows: |
---|
71 | 71 | | Sec. 391.094. DUTY NOT TO DISCRIMINATE. A commercial |
---|
72 | 72 | | establishment or nonprofit attraction identified on a specific |
---|
73 | 73 | | information logo sign shall conform to all applicable laws |
---|
74 | 74 | | concerning the provision of public accommodations without regard to |
---|
75 | 75 | | race, religion, color, sex, or national origin. |
---|
76 | 76 | | Sec. 391.095. PLACEMENT OF SIGNS. (a) The contractor |
---|
77 | 77 | | installing a specific information logo sign shall place the sign so |
---|
78 | 78 | | that: |
---|
79 | 79 | | (1) the sign is at least 800 feet from the previous |
---|
80 | 80 | | interchange and at least 800 feet from the exit direction sign at |
---|
81 | 81 | | the interchange from which the commercial establishment or |
---|
82 | 82 | | nonprofit attraction is accessible [services are available]; |
---|
83 | 83 | | (2) two signs having the same legend are at least 800 |
---|
84 | 84 | | feet apart, but are not excessively spaced; and |
---|
85 | 85 | | (3) a motorist, after following the sign, can |
---|
86 | 86 | | conveniently reenter the highway and continue in the original |
---|
87 | 87 | | direction of travel. |
---|
88 | 88 | | (b) A specific information logo sign that is placed along a |
---|
89 | 89 | | ramp or at a ramp terminal must be a duplicate of the corresponding |
---|
90 | 90 | | [establishment] logo sign located at an interchange, except that |
---|
91 | 91 | | the ramp sign must: |
---|
92 | 92 | | (1) be smaller; |
---|
93 | 93 | | (2) include the distance to the commercial |
---|
94 | 94 | | establishment or nonprofit attraction; and |
---|
95 | 95 | | (3) include directional arrows instead of directions |
---|
96 | 96 | | shown in words. |
---|
97 | 97 | | (c) If the commercial establishment or nonprofit attraction |
---|
98 | 98 | | is [service facilities are] not visible from an interchange ramp |
---|
99 | 99 | | terminal, additional signs may be placed along the ramp or at the |
---|
100 | 100 | | ramp terminal. |
---|
101 | 101 | | SECTION 5. This Act takes effect September 1, 2021. |
