66 AN ACT
77 relating to the inclusion of a nonprofit attraction on a specific
88 information logo sign.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 391.001, Transportation Code, is amended
1111 by adding Subdivision (10) and amending Subdivision (12) to read as
1212 follows:
1313 (10) "Nonprofit attraction" means an establishment,
1414 including a museum, monument, or park, that:
1515 (A) is exempt from income taxation under Section
1616 501(a), Internal Revenue Code of 1986, by being listed under
1717 Section 501(c)(3) of that code; and
1818 (B) meets the criteria established by the
1919 department by rule under Section 391.093(i).
2020 (12) "Specific information logo sign" means a
2121 rectangular sign imprinted with:
2222 (A) the words "GAS," "FOOD," "LODGING,"
2323 "CAMPING," [or] "24 HOUR Rx," or "ATTRACTION" or with a combination
2424 of those words;[,] and
2525 (B) the specific brand names of commercial
2626 establishments offering those services or names of nonprofit
2727 attractions, as applicable.
2828 SECTION 2. Section 391.091(b-1), Transportation Code, is
2929 amended to read as follows:
3030 (b-1) A contract under this section shall provide for:
3131 (1) the assessment of fees to be paid to a contractor
3232 by a commercial establishment or nonprofit attraction eligible for
3333 display on the specific information logo sign; and
3434 (2) remittance to the department of at least 10
3535 percent of the fees collected by the contractor.
3636 SECTION 3. Section 391.093, Transportation Code, is amended
3737 by amending Subsection (a) and adding Subsections (a-1), (a-2), and
3838 (i) to read as follows:
3939 (a) A commercial establishment, to be eligible to have its
4040 name displayed on a specific information logo sign, must:
4141 (1) provide gas, food, lodging, camping, or pharmacy
4242 services; and
4343 (2) be located not more than three miles from an
4444 interchange on an eligible highway.
4545 (a-1) A nonprofit attraction, to be eligible to have its
4646 name displayed on a specific information logo sign, must be located
4747 not more than three miles from an interchange on an eligible
4848 highway.
4949 (a-2) If no commercial establishment or nonprofit
5050 attraction [service] participating or willing to participate in the
5151 specific information logo sign program is located within three
5252 miles of an interchange, the commission may grant permits for
5353 commercial establishments and nonprofit attractions located not
5454 farther than:
5555 (1) six miles from the interchange;
5656 (2) nine miles from the interchange if no
5757 establishment or attraction [service] participating or willing to
5858 participate in the program is located within six miles from the
5959 interchange;
6060 (3) 12 miles from the interchange if no establishment
6161 or attraction [service] participating or willing to participate in
6262 the program is located within nine miles of the interchange; or
6363 (4) 15 miles from the interchange if no establishment
6464 or attraction [service] participating or willing to participate in
6565 the program is located within 12 miles of the interchange.
6666 (i) The department by rule shall establish criteria for
6767 establishments that are eligible for inclusion as nonprofit
6868 attractions on specific information logo signs.
6969 SECTION 4. Sections 391.094 and 391.095, Transportation
7070 Code, are amended to read as follows:
7171 Sec. 391.094. DUTY NOT TO DISCRIMINATE. A commercial
7272 establishment or nonprofit attraction identified on a specific
7373 information logo sign shall conform to all applicable laws
7474 concerning the provision of public accommodations without regard to
7575 race, religion, color, sex, or national origin.
7676 Sec. 391.095. PLACEMENT OF SIGNS. (a) The contractor
7777 installing a specific information logo sign shall place the sign so
7878 that:
7979 (1) the sign is at least 800 feet from the previous
8080 interchange and at least 800 feet from the exit direction sign at
8181 the interchange from which the commercial establishment or
8282 nonprofit attraction is accessible [services are available];
8383 (2) two signs having the same legend are at least 800
8484 feet apart, but are not excessively spaced; and
8585 (3) a motorist, after following the sign, can
8686 conveniently reenter the highway and continue in the original
8787 direction of travel.
8888 (b) A specific information logo sign that is placed along a
8989 ramp or at a ramp terminal must be a duplicate of the corresponding
9090 [establishment] logo sign located at an interchange, except that
9191 the ramp sign must:
9292 (1) be smaller;
9393 (2) include the distance to the commercial
9494 establishment or nonprofit attraction; and
9595 (3) include directional arrows instead of directions
9696 shown in words.
9797 (c) If the commercial establishment or nonprofit attraction
9898 is [service facilities are] not visible from an interchange ramp
9999 terminal, additional signs may be placed along the ramp or at the
100100 ramp terminal.
101101 SECTION 5. This Act takes effect September 1, 2021.
