55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a report on state actions to prevent chemical
88 dependency facilities from engaging in certain prohibited
99 solicitation practices.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 164, Health and Safety Code, is amended
1212 by adding Section 164.015 to read as follows:
1313 Sec. 164.015. ANNUAL REPORT ON STATE ACTIONS TO PREVENT
1414 CERTAIN PROHIBITED SOLICITATION PRACTICES. (a) Not later than
1515 November 1 of each year, the office of the attorney general, in
1616 conjunction with the commission, shall prepare a written report on
1717 actions brought on behalf of this state during the preceding state
1818 fiscal year, including actions to assess a civil or an
1919 administrative penalty or to impose an injunction, against a
2020 chemical dependency facility for a violation of:
2121 (1) this chapter related to prohibited solicitation
2222 practices; or
2323 (2) Chapter 102, Occupations Code, related to
2424 prohibited solicitation practices.
2525 (b) The office of the attorney general shall:
2626 (1) submit the report prepared under Subsection (a) to
2727 the executive commissioner and the members of each standing
2828 committee of the legislature with jurisdiction over public health;
2929 and
3030 (2) post the report on the attorney general's Internet
3131 website.
3232 SECTION 2. Notwithstanding Section 164.015, Health and
3333 Safety Code, as added by this Act, the office of the attorney
3434 general is not required to submit the first report under that
3535 section until November 1, 2022.
3636 SECTION 3. This Act takes effect September 1, 2021.
