| 10 | 10 | SECTION 1. Section 12.1058, Education Code, is amended by | |
| 11 | 11 | adding Subsection (d) to read as follows: | |
| 12 | 12 | (d) If an open-enrollment charter school has 5,000 or more | |
| 13 | 13 | students in average daily attendance as determined under Section | |
| 14 | 14 | 48.005, the school is considered to be a state agency for purposes | |
| 15 | 15 | of Chapter 2161, Government Code. | |
| 16 | 16 | SECTION 2. This Act takes effect immediately if it receives | |
| 17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
| 18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
| 19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
| 20 | 20 | Act takes effect September 1, 2021. |
