55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the issuance of a certified birth record, driver's
88 license, or personal identification certificate to a homeless
99 individual.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1212 Code, is amended by adding Section 191.00495 to read as follows:
1313 Sec. 191.00495. BIRTH RECORD ISSUED TO HOMELESS INDIVIDUAL.
1414 (a) In this section, "homeless individual":
1515 (1) means an individual who:
1616 (A) lacks a fixed, regular, and adequate
1717 nighttime residence; or
1818 (B) has a primary nighttime residence that is:
1919 (i) a supervised publicly or privately
2020 operated shelter designed to provide temporary living
2121 accommodations, including welfare hotels, congregate shelters, and
2222 transitional housing for persons with mental illness;
2323 (ii) an institution that provides a
2424 temporary residence for individuals intended to be
2525 institutionalized; or
2626 (iii) a public or private place not
2727 designed for, or ordinarily used as, a regular sleeping
2828 accommodation for human beings; and
2929 (2) does not include an individual who is imprisoned
3030 or otherwise detained in a correctional facility.
3131 (b) On request of a homeless individual, the state
3232 registrar, a local registrar, or a county clerk shall issue,
3333 without fee, a certified copy of the individual's birth record to
3434 the individual.
3535 (c) The department by rule shall:
3636 (1) adopt a process to verify a person's status as a
3737 homeless individual; and
3838 (2) prescribe the documentation necessary for the
3939 issuance of a certified copy of a birth record to a homeless
4040 individual whose status is verified through the process adopted
4141 under Subdivision (1).
4242 (d) In adopting a verification process under Subsection
4343 (c), the department shall allow a person requesting a birth record
4444 to provide a letter certifying the person is a homeless individual
4545 that is issued by:
4646 (1) the director of an emergency shelter or
4747 transitional housing program funded by the United States Department
4848 of Housing and Urban Development; or
4949 (2) the director of:
5050 (A) a shelter for homeless individuals; or
5151 (B) a transitional living program.
5252 (e) Notwithstanding any other law of this state, the
5353 department may not require a homeless individual to provide a
5454 physical address of the individual's residence to satisfy any
5555 requirement of this section.
5656 SECTION 2. Subchapter I, Chapter 521, Transportation Code,
5757 is amended by adding Section 521.184 to read as follows:
5858 Sec. 521.184. ISSUANCE OF LICENSE OR CERTIFICATE TO
5959 HOMELESS INDIVIDUAL. (a) In this section, "homeless individual"
6060 has the meaning assigned by Section 191.00495, Health and Safety
6161 Code.
6262 (b) The department by rule shall:
6363 (1) adopt a process to verify a person's status as a
6464 homeless individual;
6565 (2) prescribe the documentation necessary for the
6666 issuance of a driver's license or personal identification
6767 certificate to a homeless individual; and
6868 (3) exempt a homeless individual from the payment of
6969 fees under this chapter for the issuance of a driver's license or
7070 personal identification certificate, subject to Section 521.4265.
7171 (c) In adopting a verification process under Subsection
7272 (b), the department shall allow a person applying for a driver's
7373 license or personal identification certificate to provide a letter
7474 certifying the person is a homeless individual that is issued by:
7575 (1) the director of an emergency shelter or
7676 transitional housing program funded by the United States Department
7777 of Housing and Urban Development; or
7878 (2) the director of:
7979 (A) a shelter for homeless individuals; or
8080 (B) a transitional living program.
8181 (d) Notwithstanding any other law of this state and to the
8282 extent permitted under federal law, the department may not require
8383 a homeless individual to provide a physical address of the
8484 individual's residence to satisfy any requirement of this chapter.
8585 (e) Rules adopted under this section regarding the issuance
8686 of a personal identification certificate to a homeless child or
8787 youth, as defined by Section 521.1015, must be consistent with the
8888 provisions of that section.
8989 SECTION 3. Sections 521.4265(b) and (c), Transportation
9090 Code, are amended to read as follows:
9191 (b) For each exemption granted under Section 521.1015, [or]
9292 521.1811, or 521.184, the department shall deposit to the credit of
9393 the Texas mobility fund an amount from the identification fee
9494 exemption account under Subsection (a) that is equal to the amount
9595 of the waived fee that would otherwise be deposited to the mobility
9696 fund.
9797 (c) The department may not grant an exemption under Section
9898 521.1015, [or] 521.1811, or 521.184 if money is not available in the
9999 identification fee exemption account to meet the requirements of
100100 Subsection (b).
101101 SECTION 4. The changes in law made by this Act apply to an
102102 application for a birth record, driver's license, or personal
103103 identification certificate submitted on or after the effective date
104104 of this Act. An application for a birth record, driver's license, or
105105 personal identification certificate submitted before the effective
106106 date of this Act is governed by the law in effect on the date the
107107 application was submitted, and the former law is continued in
108108 effect for that purpose.
109109 SECTION 5. This Act takes effect September 1, 2021.
