55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to permissible uses of the instructional materials and
88 technology allotment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.0211(c), Education Code, is amended
1111 to read as follows:
1212 (c) Subject to Subsection (d), funds allotted under this
1313 section may be used to:
1414 (1) purchase:
1515 (A) materials on the list adopted by the
1616 commissioner, as provided by Section 31.0231;
1717 (B) instructional materials, regardless of
1818 whether the instructional materials are on the list adopted under
1919 Section 31.024;
2020 (C) consumable instructional materials,
2121 including workbooks;
2222 (D) instructional materials for use in bilingual
2323 education classes, as provided by Section 31.029;
2424 (E) instructional materials for use in college
2525 preparatory courses under Section 28.014, as provided by Section
2626 31.031;
2727 (F) supplemental instructional materials, as
2828 provided by Section 31.035;
2929 (G) state-developed open education resource
3030 instructional materials, as provided by Subchapter B-1;
3131 (H) instructional materials and technological
3232 equipment under any continuing contracts of the district in effect
3333 on September 1, 2011;
3434 (I) technological equipment necessary to support
3535 the use of materials included on the list adopted by the
3636 commissioner under Section 31.0231 or any instructional materials
3737 purchased with an allotment under this section; and
3838 (J) inventory software or systems for storing,
3939 managing, and accessing instructional materials and analyzing the
4040 usage and effectiveness of the instructional materials; and
4141 (2) pay:
4242 (A) for training educational personnel directly
4343 involved in student learning in the appropriate use of
4444 instructional materials and for providing for access to
4545 technological equipment for instructional use; [and]
4646 (B) the salary and other expenses of an employee
4747 who provides technical support for the use of technological
4848 equipment directly involved in student learning; and
4949 (C) for costs associated with distance learning,
5050 including Wi-Fi, Internet access hotspots, wireless network
5151 service, broadband service, and other services and technological
5252 equipment necessary to facilitate Internet access.
5353 SECTION 2. This Act applies beginning with the 2021-2022
5454 school year.
5555 SECTION 3. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2021.
