79 relating to a state employment preference for certain individuals
810 who reside with veterans with a disability.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 657.002, Government Code, is amended to
1113 read as follows:
1214 Sec. 657.002. INDIVIDUALS QUALIFIED FOR VETERAN'S
1315 EMPLOYMENT PREFERENCE. The following individuals qualify for a
1416 veteran's employment preference:
1517 (1) a veteran, including a veteran with a disability;
1618 (2) a veteran's surviving spouse who has not
1719 remarried; [and]
1820 (3) an orphan of a veteran if the veteran was killed
1921 while on active duty; and
2022 (4) an individual who resides in a household with a
2123 veteran if the individual is the primary source of income for the
2224 household and the veteran:
2325 (A) has a total disability rating based either on
2426 having a service-connected disability with a disability rating of
2527 100 percent or on individual unemployability; and
2628 (B) is receiving Supplemental Security Income
2729 (SSI) benefits under 42 U.S.C. Section 1381 et seq. or Social
2830 Security Disability Insurance (SSDI) benefits under 42 U.S.C.
2931 Section 401 et seq.
3032 SECTION 2. Section 657.003(b), Government Code, is amended
3133 to read as follows:
3234 (b) A state agency shall provide to an individual entitled
3335 to a veteran's employment preference for employment or appointment
3436 over other applicants for the same position who do not have a
3537 greater qualification a veteran's employment preference, in the
3638 following order of priority:
3739 (1) a veteran with a disability;
3840 (2) a veteran;
3941 (3) a veteran's surviving spouse who has not
4042 remarried; [and]
4143 (4) an orphan of a veteran if the veteran was killed
4244 while on active duty; and
4345 (5) an individual who resides with a veteran with a
4446 disability as described by Section 657.002(4) if the individual is
4547 the primary source of income for the veteran's household.
4648 SECTION 3. Section 657.005(b), Government Code, is amended
4749 to read as follows:
4850 (b) An applicant who is either a veteran with a disability
4951 as described by Section 657.002(4) or an individual who resides
5052 with a veteran with a disability as described by Section 657.002(4)
5153 if the individual is the primary source of income for the veteran's
5254 household shall furnish the official records to the individual
5355 whose duty is to fill the position.
5456 SECTION 4. The changes in law made by this Act apply only to
5557 an open position with a state agency for which the state agency
5658 begins accepting applications on or after the effective date of
5759 this Act. An open position with a state agency for which the state
5860 agency begins accepting applications before the effective date of
5961 this Act is governed by the law in effect on the date the state
6062 agency began accepting applications, and the former law is
6163 continued in effect for that purpose.
6264 SECTION 5. This Act takes effect September 1, 2021.
