9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to court reporter costs incurred in a hearing or
612 proceeding for the involuntary detention of a person with mental
713 illness.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 571.018(c), Health and Safety Code, is
1016 amended to read as follows:
1117 (c) Costs under this section include:
1218 (1) attorney's fees;
1319 (2) physician examination fees;
1420 (3) compensation for court-appointed personnel listed
1521 under Section 571.017;
1622 (4) expenses of transportation to a mental health
1723 facility or to a federal agency not to exceed $50 if transporting
1824 within the same county and not to exceed the reasonable cost of
1925 transportation if transporting between counties;
2026 (5) costs and salary supplements authorized under
2127 Sections 574.031(i) and (j); [and]
2228 (6) prosecutor's fees authorized under Section
2329 574.031(k); and
2430 (7) court reporter costs.
2531 SECTION 2. Section 571.018(c), Health and Safety Code, as
2632 amended by this Act, applies only to the court reporter costs
2733 incurred on or after the effective date of this Act. Court reporter
2834 costs incurred before the effective date of this Act are governed by
2935 the law in effect when the hearing was initiated, and the former law
3036 is continued in effect for that purpose.
3137 SECTION 3. This Act takes effect September 1, 2021.
