| 5 | 11 | | relating to court reporter costs incurred in a hearing or |
|---|
| 6 | 12 | | proceeding for the involuntary detention of a person with mental |
|---|
| 7 | 13 | | illness. |
|---|
| 8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 15 | | SECTION 1. Section 571.018(c), Health and Safety Code, is |
|---|
| 10 | 16 | | amended to read as follows: |
|---|
| 11 | 17 | | (c) Costs under this section include: |
|---|
| 12 | 18 | | (1) attorney's fees; |
|---|
| 13 | 19 | | (2) physician examination fees; |
|---|
| 14 | 20 | | (3) compensation for court-appointed personnel listed |
|---|
| 15 | 21 | | under Section 571.017; |
|---|
| 16 | 22 | | (4) expenses of transportation to a mental health |
|---|
| 17 | 23 | | facility or to a federal agency not to exceed $50 if transporting |
|---|
| 18 | 24 | | within the same county and not to exceed the reasonable cost of |
|---|
| 19 | 25 | | transportation if transporting between counties; |
|---|
| 20 | 26 | | (5) costs and salary supplements authorized under |
|---|
| 21 | 27 | | Sections 574.031(i) and (j); [and] |
|---|
| 22 | 28 | | (6) prosecutor's fees authorized under Section |
|---|
| 23 | 29 | | 574.031(k); and |
|---|
| 24 | 30 | | (7) court reporter costs. |

| 25 | 31 | | SECTION 2. Section 571.018(c), Health and Safety Code, as |
|---|
| 26 | 32 | | amended by this Act, applies only to the court reporter costs |
|---|
| 27 | 33 | | incurred on or after the effective date of this Act. Court reporter |
|---|
| 28 | 34 | | costs incurred before the effective date of this Act are governed by |
|---|
| 29 | 35 | | the law in effect when the hearing was initiated, and the former law |
|---|
| 30 | 36 | | is continued in effect for that purpose. |
|---|
| 31 | 37 | | SECTION 3. This Act takes effect September 1, 2021. |
