7 | 7 | | relating to the display of the national motto in public schools and |

8 | 8 | | institutions of higher education. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 1.004, Education Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 1.004. DISPLAY OF NATIONAL MOTTO. (a) A public |
---|
13 | 13 | | elementary or secondary school or an institution of higher |
---|
14 | 14 | | education as defined by Section 61.003 must [may] display in a |
---|
15 | 15 | | conspicuous place in each building of the school or institution a |
---|
16 | 16 | | durable poster or framed copy of the United States national motto, |
---|
17 | 17 | | "In God We Trust," if the poster or framed copy meets the |
---|
18 | 18 | | requirements of Subsection (b) and is: |
---|
19 | 19 | | (1) donated for display at the school or institution; |
---|
20 | 20 | | or |
---|
21 | 21 | | (2) purchased from private donations and made |
---|
22 | 22 | | available to the school or institution [in each classroom, |
---|
23 | 23 | | auditorium, and cafeteria]. |
---|
24 | 24 | | (b) A poster or framed copy of the national motto described |
---|
25 | 25 | | by Subsection (a) must contain a representation of the United |
---|
26 | 26 | | States flag centered under the national motto and a representation |
---|
27 | 27 | | of the state flag. |
---|
28 | 28 | | (c) A public elementary or secondary school and an |
---|
29 | 29 | | institution of higher education may accept and use private |
---|
30 | 30 | | donations for the purposes of Subsection (a). |
---|
31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
---|
32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
---|
33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
---|
35 | 35 | | Act takes effect September 1, 2021. |
