55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the dissolution by petition of a municipal management
88 district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 375.262, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 375.262. DISSOLUTION BY PETITION BY OWNERS. Except as
1313 limited by Section 375.264, the board shall dissolve the district
1414 on written petition filed with the board by:
1515 (1) in a district created on or after September 1,
1616 2017, the owners of at least two-thirds of the assessed value of the
1717 property subject to assessment or taxation by the district based on
1818 the most recent certified county property tax rolls; or
1919 (2) in a district created before September 1, 2017,
2020 the owners of at least 55 percent of the assessed value of the
2121 property subject to assessment or taxation by the district based on
2222 the most recent certified county property tax rolls.
2323 SECTION 2. Section 68.352(b), Water Code, is amended to
2424 read as follows:
2525 (b) The board shall dissolve the district on written
2626 petition filed with the board by the owners of at least two-thirds
2727 of the assessed value of the property subject to assessment or
2828 taxation by the district based on the most recent certified county
2929 property tax rolls [A district may be dissolved as provided by
3030 Section 375.262, Local Government Code].
3131 SECTION 3. The changes in law made by this Act apply only to
3232 a petition described by Section 375.262, Local Government Code,
3333 filed on or after the effective date of this Act. A petition filed
3434 before the effective date of this Act is governed by the law in
3535 effect on the date the petition was filed, and the former law is
3636 continued in effect for that purpose.
3737 SECTION 4. This Act takes effect September 1, 2021.
