55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to communicable disease and infection prevention and
88 control measures for certain long-term care facilities;
99 authorizing an administrative penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 81.014, Health and Safety Code, is
1212 amended to read as follows:
1313 Sec. 81.014. LONG-TERM CARE FACILITY INFECTION PREVENTION
1414 AND CONTROL PROGRAMS [PROGRAM]. (a) Each long-term care facility
1515 shall, with advice from and subject to the approval of a quality
1616 assessment and assurance committee designated under Subsection
1717 (c), establish and maintain an [facility's] infection prevention
1818 and control program designed to:
1919 (1) provide to facility residents and staff a safe,
2020 sanitary, and comfortable environment; and
2121 (2) help prevent the development and transmission of
2222 communicable diseases and infections among facility residents and
2323 staff.
2424 (b) A long-term care facility's infection prevention and
2525 control program must include:
2626 (1) monitoring of key infectious agents, including
2727 multidrug-resistant organisms; [and]
2828 (2) procedures for making rapid influenza diagnostic
2929 tests available to facility residents and staff; and
3030 (3) procedures for ensuring that rapid antigen
3131 COVID-19 viral tests are available to facility residents and staff
3232 as needed.
3333 (c) Each long-term care facility shall designate a quality
3434 assessment and assurance committee to approve and monitor the
3535 facility's infection prevention and control program. The facility's
3636 committee must include:
3737 (1) the facility's director of nursing or an
3838 equivalent consultant with the facility;
3939 (2) the facility's medical director or the director's
4040 designee;
4141 (3) not less than three members of the facility's
4242 staff, at least one of whom must be a facility administrator, a
4343 facility board member, or another individual in a leadership
4444 position with the facility; and
4545 (4) the facility's primary infection preventionist
4646 designated under Section 81.0145.
4747 (d) A long-term care facility's quality assessment and
4848 assurance committee shall:
4949 (1) conduct an annual review of the facility's
5050 infection prevention and control program and modify the program as
5151 necessary; and
5252 (2) present the findings of each review conducted
5353 under Subdivision (1) to facility staff and residents at annual
5454 meetings that are open to the public.
5555 (e) A long-term care facility's primary infection
5656 preventionist designated under Section 81.0145 shall:
5757 (1) with the assistance of the facility's secondary
5858 infection preventionist designated under that section, implement
5959 the facility's infection prevention and control program; and
6060 (2) submit regular reports to the facility's quality
6161 assessment and assurance committee on the implementation of the
6262 program.
6363 SECTION 2. Subchapter A, Chapter 81, Health and Safety
6464 Code, is amended by adding Sections 81.0145 and 81.0146 to read as
6565 follows:
6666 Sec. 81.0145. LONG-TERM CARE FACILITY INFECTION
6767 PREVENTIONISTS. (a) Each long-term care facility shall designate
6868 a primary and a secondary infection preventionist. The primary and
6969 secondary infection preventionists must:
7070 (1) have professional training or other specialized
7171 training in nursing, medical technology, microbiology, or another
7272 related field;
7373 (2) have completed specialized training in infection
7474 prevention and control;
7575 (3) work at least part-time at the facility; and
7676 (4) annually complete at least eight hours of training
7777 approved by the commission related to infectious diseases and
7878 vaccinations.
7979 (b) A long-term care facility's primary infection
8080 preventionist and, under the direction of the primary infection
8181 preventionist, secondary infection preventionist shall:
8282 (1) implement the facility's infection prevention and
8383 control program in the manner described by Section 81.014;
8484 (2) serve as the facility's contact for the local
8585 health department or health authority to notify the facility of a
8686 potential exposure to a reportable disease at the facility;
8787 (3) notify the local health department or health
8888 authority of a potential exposure to a reportable disease at the
8989 facility not later than eight hours from the time of exposure;
9090 (4) notify staff, residents, and resident
9191 representatives not later than 12 hours from the time a reportable
9292 disease at the facility is verified;
9393 (5) investigate and evaluate incidents during which
9494 facility residents or staff were or may have been exposed to a
9595 communicable disease, using current evidence-based information on
9696 the possible risks associated with exposure to the communicable
9797 disease;
9898 (6) implement control measures to prevent the spread
9999 of infection of a communicable disease among facility residents and
100100 staff, including:
101101 (A) immunization;
102102 (B) detention;
103103 (C) restrictions;
104104 (D) disinfection;
105105 (E) decontamination;
106106 (F) isolation;
107107 (G) quarantine;
108108 (H) disinfestation;
109109 (I) chemoprophylaxis;
110110 (J) preventive therapy;
111111 (K) prevention methods; and
112112 (L) education;
113113 (7) in accordance with applicable law, monitor all
114114 treatment provided to a facility resident or staff member who is
115115 exposed to and as a result of that exposure infected with a
116116 communicable disease at the facility;
117117 (8) maintain records of and respond in a timely
118118 manner, as determined by the facility, to each communicable disease
119119 complaint made by facility staff, residents, or resident
120120 representatives;
121121 (9) as required by the executive commissioner, submit
122122 to the department or the local health department or health
123123 authority accurate information on the total number of cases of a
124124 reportable disease among facility residents or staff; and
125125 (10) perform other duties for the facility as assigned
126126 by the executive commissioner.
127127 (c) A primary or secondary infection preventionist may not
128128 serve concurrently as an infection preventionist for more than
129129 three long-term care facilities.
130130 (d) Each long-term care facility shall provide to the local
131131 health department or health authority the names and qualifications
132132 of the facility's primary and secondary infection preventionists.
133133 Sec. 81.0146. ADMINISTRATIVE PENALTY RELATED TO LONG-TERM
134134 CARE FACILITY COMMUNICABLE DISEASE AND PREVENTION CONTROL
135135 MEASURES. (a) The commission may impose an administrative penalty
136136 against a long-term care facility that violates Section 81.014 or
137137 81.0145 in an amount determined by the executive commissioner in
138138 accordance with commission rules.
139139 (b) The amount of an administrative penalty imposed under
140140 this section shall be based on:
141141 (1) the seriousness of the violation, including the
142142 nature, circumstances, extent, and gravity of any prohibited acts,
143143 and the hazard or potential hazard created to the health and safety
144144 of facility residents and staff;
145145 (2) enforcement costs relating to the violation;
146146 (3) the history of previous violations;
147147 (4) the amount necessary to deter future violations;
148148 (5) efforts to correct the violation; and
149149 (6) any other matter that justice may require.
150150 SECTION 3. (a) As soon as practicable after the effective
151151 date of this Act, each long-term care facility licensed under
152152 Chapter 242, 247, or 252, Health and Safety Code, shall:
153153 (1) establish an infection prevention and control
154154 program and designate a quality assessment and assurance committee
155155 to approve the program as required by Section 81.014, Health and
156156 Safety Code, as amended by this Act; and
157157 (2) designate a primary and a secondary infection
158158 preventionist as required by Section 81.0145, Health and Safety
159159 Code, as added by this Act.
160160 (b) As soon as practicable after the effective date of this
161161 Act, the executive commissioner of the Health and Human Services
162162 Commission shall adopt the rules necessary to implement the changes
163163 in law made by this Act.
164164 SECTION 4. This Act takes effect September 1, 2021.
