410 AN ACT
511 relating to certain procedures regarding court-ordered financial
612 support for a child in the conservatorship of the Department of
713 Family and Protective Services.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 154.001, Family Code, is amended by
1016 amending Subsection (b) and adding Subsection (b-1) to read as
1117 follows:
1218 (b) The court may order either or both parents to make
1319 periodic payments for the support of a child in a proceeding in
1420 which the Department of Family and Protective [and Regulatory]
1521 Services is named temporary managing conservator. In a proceeding
1622 in which the Department of Family and Protective [and Regulatory]
1723 Services is named permanent managing conservator of a child whose
1824 parents' rights have not been terminated, the court shall order
1925 each parent that is financially able to make periodic payments for
2026 the support of the child.
2127 (b-1) In a proceeding described by Subsection (b) in which
2228 the court renders an order modifying an existing order for the
2329 support of the child to require that the payments be made to the
2430 Department of Family and Protective Services, the court shall
2531 provide notice of the order to the office of the attorney general
2632 not later than the 10th day after the date the order is rendered.
2733 SECTION 2. The change in law made by this Act applies only
2834 to a proceeding that is pending in a trial court on or filed on or
2935 after the effective date of this Act.
3036 SECTION 3. This Act takes effect September 1, 2021.
