| 5 | 11 | | relating to certain procedures regarding court-ordered financial |

| 6 | 12 | | support for a child in the conservatorship of the Department of |

| 7 | 13 | | Family and Protective Services. |
|---|
| 8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 15 | | SECTION 1. Section 154.001, Family Code, is amended by |
|---|
| 10 | 16 | | amending Subsection (b) and adding Subsection (b-1) to read as |
|---|
| 11 | 17 | | follows: |
|---|
| 12 | 18 | | (b) The court may order either or both parents to make |
|---|
| 13 | 19 | | periodic payments for the support of a child in a proceeding in |
|---|
| 14 | 20 | | which the Department of Family and Protective [and Regulatory] |
|---|
| 15 | 21 | | Services is named temporary managing conservator. In a proceeding |
|---|
| 16 | 22 | | in which the Department of Family and Protective [and Regulatory] |
|---|
| 17 | 23 | | Services is named permanent managing conservator of a child whose |
|---|
| 18 | 24 | | parents' rights have not been terminated, the court shall order |
|---|
| 19 | 25 | | each parent that is financially able to make periodic payments for |
|---|
| 20 | 26 | | the support of the child. |
|---|
| 21 | 27 | | (b-1) In a proceeding described by Subsection (b) in which |
|---|
| 22 | 28 | | the court renders an order modifying an existing order for the |
|---|
| 23 | 29 | | support of the child to require that the payments be made to the |
|---|
| 24 | 30 | | Department of Family and Protective Services, the court shall |
|---|
| 25 | 31 | | provide notice of the order to the office of the attorney general |
|---|
| 26 | 32 | | not later than the 10th day after the date the order is rendered. |
|---|
| 27 | 33 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 28 | 34 | | to a proceeding that is pending in a trial court on or filed on or |
|---|
| 29 | 35 | | after the effective date of this Act. |
|---|
| 30 | 36 | | SECTION 3. This Act takes effect September 1, 2021. |
