66 AN ACT
77 relating to prescribing low-THC cannabis under the Texas
88 Compassionate Use Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 169.002, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 169.002. PHYSICIAN QUALIFIED TO PRESCRIBE LOW-THC
1313 CANNABIS [TO PATIENTS WITH CERTAIN MEDICAL CONDITIONS]. (a) Only a
1414 physician qualified [with respect to a patient's particular medical
1515 condition] as provided by this section may prescribe low-THC
1616 cannabis in accordance with this chapter [to treat the applicable
1717 medical condition].
1818 (b) A physician is qualified to prescribe low-THC cannabis
1919 to alleviate the symptoms of [with respect to] a patient's
2020 particular medical condition or the symptoms caused by other
2121 treatments for that medical condition if the physician:
2222 (1) is licensed under this subtitle;
2323 (2) is board certified in a medical specialty relevant
2424 to the treatment of the patient's particular medical condition by a
2525 specialty board approved by the American Board of Medical
2626 Specialties or the Bureau of Osteopathic Specialists; and
2727 (3) dedicates a significant portion of clinical
2828 practice to the evaluation and treatment of the patient's
2929 particular medical condition, and the treatment of symptoms caused
3030 by that medical condition and by other treatments for that medical
3131 condition.
3232 SECTION 2. Section 169.003, Occupations Code, is amended to
3333 read as follows:
3434 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A
3535 physician described by Section 169.002 may prescribe low-THC
3636 cannabis to a patient if:
3737 (1) the patient is a permanent resident of the state;
3838 (2) the physician complies with the registration
3939 requirements of Section 169.004; and
4040 (3) the physician certifies to the department that:
4141 (A) the patient is diagnosed with a medical
4242 condition that produces symptoms, or the treatment of which
4343 produces symptoms, that are alleviated by medical use of low-THC
4444 cannabis [:
4545 [(i) epilepsy;
4646 [(ii) a seizure disorder;
4747 [(iii) multiple sclerosis;
4848 [(iv) spasticity;
4949 [(v) amyotrophic lateral sclerosis;
5050 [(vi) autism;
5151 [(vii) terminal cancer; or
5252 [(viii) an incurable neurodegenerative
5353 disease]; and
5454 (B) the physician determines the risk of the
5555 medical use of low-THC cannabis by the patient is reasonable in
5656 light of the potential benefit for the patient.
5757 SECTION 3. Sections 169.001(1-a) and (6), Occupations Code,
5858 are repealed.
5959 SECTION 4. This Act takes effect September 1, 2021.
