89 relating to adverse disproportionalities within the child
910 protective services system.
1011 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1112 SECTION 1. Subchapter B, Chapter 40, Human Resources Code,
1213 is amended by adding Section 40.028 to read as follows:
1314 Sec. 40.028. ANALYZING AND ADDRESSING ADVERSE
1415 DISPROPORTIONALITY. (a) The commissioner shall analyze the
1516 adverse disproportionate involvement of children who are members of
1617 a demographic group in the child protective services system,
1718 including at each stage of child protective services
1819 investigations.
1920 (b) On identifying an adverse disproportionality described
2021 by Subsection (a), the commissioner shall:
2122 (1) establish a team to address the
2223 disproportionality; and
2324 (2) notify the governor, lieutenant governor, speaker
2425 of the house of representatives, and chairs of the standing
2526 committees of the senate and house of representatives having
2627 primary jurisdiction over the department of the
2728 disproportionality.
2829 (c) In appointing members to a team to address the adverse
2930 disproportionality, the commissioner shall appoint representatives
3031 with expertise in different subjects relevant to the
3132 disproportionality.
3233 (d) The commissioner shall direct the team to:
3334 (1) research an evidence-based approach to address the
3435 adverse disproportionality;
3536 (2) identify resources for addressing and eliminating
3637 or reducing the disproportionality; and
3738 (3) assist the commissioner in obtaining those
3839 resources from and if necessary requesting those resources from the
3940 legislature.
4041 (e) The commissioner shall set a time to complete the
4142 elimination or reduction of the adverse disproportionality and
4243 measures for determining whether the disproportionality has been
4344 eliminated or reduced.
4445 (f) As soon as practicable, the commissioner shall report to
4546 the governor, lieutenant governor, speaker of the house of
4647 representatives, and chairs of the standing committees of the
4748 senate and house of representatives having primary jurisdiction
4849 over the department on:
4950 (1) the evidence-based approach the department will
5051 use to eliminate or reduce the adverse disproportionality;
5152 (2) the resources needed to eliminate or reduce the
5253 disproportionality;
5354 (3) the time set to complete the elimination or
5455 reduction of the disproportionality; and
5556 (4) the strategic plan and measures to eliminate or
5657 reduce the adverse disproportionality.
5758 (g) At the conclusion of the time set by the commissioner to
5859 complete the elimination or reduction of the adverse
5960 disproportionality, the commissioner shall report to the governor,
6061 lieutenant governor, speaker of the house of representatives, and
6162 chairs of the standing committees of the senate and house of
6263 representatives having primary jurisdiction over the department:
6364 (1) the results of the department's evidence-based
6465 approach to eliminating or reducing the disproportionality; and
6566 (2) if the department's approach:
6667 (A) successfully eliminated or reduced the
6768 disproportionality, the department's plan for ensuring the
6869 disproportionality is not reinstated or expanded; or
6970 (B) failed to eliminate or reduce the
7071 disproportionality:
7172 (i) the reasons the approach failed; and
7273 (ii) the new strategic plan and measures
7374 the department will implement to eliminate or reduce the
7475 disproportionality.
7576 SECTION 2. This Act takes effect September 1, 2021.
