55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an exception to the application of the offense of
88 possessing or delivering drug paraphernalia for persons involved in
99 certain pilot programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. This Act shall be cited as the Honorable Ruth
1212 Jones McClendon Act.
1313 SECTION 2. Section 481.125, Health and Safety Code, is
1414 amended by adding Subsection (g) to read as follows:
1515 (g) It is an exception to the application of Subsections (a)
1616 and (b) that the person is an employee, volunteer, duly authorized
1717 agent, or participant in, or is otherwise involved in operating, a
1818 pilot program established under other law to prevent the spread of
1919 certain infectious and communicable diseases.
2020 SECTION 3. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect when the offense was committed, and
2424 the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense is committed before the
2626 effective date of this Act if any element of the offense occurs
2727 before the effective date.
2828 SECTION 4. This Act takes effect September 1, 2021.
