7 | 7 | | relating to the practice of chiropractic. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 201.002(a), Occupations Code, is amended |
---|
10 | 10 | | by adding Subdivision (3-a) to read as follows: |
---|
11 | 11 | | (3-a) "Neuromusculoskeletal system" means the |
---|
12 | 12 | | musculoskeletal and nervous systems in relation to disorders that |
---|
13 | 13 | | manifest in both systems, including disorders of a biomechanical or |
---|
14 | 14 | | functional nature. |
---|
15 | 15 | | SECTION 2. Section 201.002(b), Occupations Code, is amended |
---|
16 | 16 | | to read as follows: |
---|
17 | 17 | | (b) A person practices chiropractic under this chapter if |
---|
18 | 18 | | the person: |
---|
19 | 19 | | (1) uses objective or subjective means to diagnose, |
---|
20 | 20 | | analyze, examine, or evaluate the biomechanical condition of the |
---|
21 | 21 | | spine and neuromusculoskeletal [musculoskeletal] system of the |
---|
22 | 22 | | human body; |
---|
23 | 23 | | (2) performs nonsurgical, nonincisive procedures, |
---|
24 | 24 | | including adjustment and manipulation, to improve the subluxation |
---|
25 | 25 | | complex or the biomechanics of the neuromusculoskeletal |
---|
26 | 26 | | [musculoskeletal] system; |
---|
27 | 27 | | (3) represents to the public that the person is a |
---|
28 | 28 | | chiropractor; or |
---|
29 | 29 | | (4) uses the term "chiropractor," "chiropractic," |
---|
30 | 30 | | "doctor of chiropractic," "D.C.," or any derivative of those terms |
---|
31 | 31 | | or initials in connection with the person's name. |
---|
32 | 32 | | SECTION 3. Section 201.003, Occupations Code, is amended by |
---|
33 | 33 | | adding Subsection (b-1) to read as follows: |
---|
34 | 34 | | (b-1) This chapter does not permit the unauthorized |
---|
35 | 35 | | practice of medicine. |
---|
36 | 36 | | SECTION 4. The amendments made by this Act are a |
---|
37 | 37 | | clarification of existing law in light of ongoing litigation over |
---|
38 | 38 | | whether any part of the nervous system is within the scope of |
---|
39 | 39 | | chiropractic and do not imply that existing law may be construed as |
---|
40 | 40 | | inconsistent with the law as amended by this Act. |
---|
41 | 41 | | SECTION 5. This Act takes effect immediately if it receives |
---|
42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
---|
43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
---|
45 | 45 | | Act takes effect September 1, 2021. |
