66 AN ACT
77 relating to the practice of chiropractic.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 201.002(a), Occupations Code, is amended
1010 by adding Subdivision (3-a) to read as follows:
1111 (3-a) "Neuromusculoskeletal system" means the
1212 musculoskeletal and nervous systems in relation to disorders that
1313 manifest in both systems, including disorders of a biomechanical or
1414 functional nature.
1515 SECTION 2. Section 201.002(b), Occupations Code, is amended
1616 to read as follows:
1717 (b) A person practices chiropractic under this chapter if
1818 the person:
1919 (1) uses objective or subjective means to diagnose,
2020 analyze, examine, or evaluate the biomechanical condition of the
2121 spine and neuromusculoskeletal [musculoskeletal] system of the
2222 human body;
2323 (2) performs nonsurgical, nonincisive procedures,
2424 including adjustment and manipulation, to improve the subluxation
2525 complex or the biomechanics of the neuromusculoskeletal
2626 [musculoskeletal] system;
2727 (3) represents to the public that the person is a
2828 chiropractor; or
2929 (4) uses the term "chiropractor," "chiropractic,"
3030 "doctor of chiropractic," "D.C.," or any derivative of those terms
3131 or initials in connection with the person's name.
3232 SECTION 3. Section 201.003, Occupations Code, is amended by
3333 adding Subsection (b-1) to read as follows:
3434 (b-1) This chapter does not permit the unauthorized
3535 practice of medicine.
3636 SECTION 4. The amendments made by this Act are a
3737 clarification of existing law in light of ongoing litigation over
3838 whether any part of the nervous system is within the scope of
3939 chiropractic and do not imply that existing law may be construed as
4040 inconsistent with the law as amended by this Act.
4141 SECTION 5. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2021.
