| 7 | 7 | | relating to the operation of a transitional housing pilot program |

| 8 | 8 | | by the Texas Department of Housing and Community Affairs. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2306.258, Government Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsections (c) and (d) to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (a) With money contributed to the Ending Homelessness fund |
|---|
| 14 | 14 | | under Section 502.415, Transportation Code [If funds are |
|---|
| 15 | 15 | | available], the department shall operate a transitional housing |
|---|
| 16 | 16 | | pilot program in four areas of this [the] state. |
|---|
| 17 | 17 | | (c) The department may: |
|---|
| 18 | 18 | | (1) operate the program in coordination with one or |
|---|
| 19 | 19 | | more counties or municipalities; and |
|---|
| 20 | 20 | | (2) provide a grant from the Ending Homelessness fund |
|---|
| 21 | 21 | | under Section 502.415, Transportation Code, to a county or |
|---|
| 22 | 22 | | municipality with which the department coordinates to operate the |
|---|
| 23 | 23 | | program. |
|---|
| 24 | 24 | | (d) The department may adopt rules as necessary to implement |
|---|
| 25 | 25 | | this section. |
|---|
| 26 | 26 | | SECTION 2. Sections 502.415(f) and (g), Transportation |
|---|
| 27 | 27 | | Code, are amended to read as follows: |
|---|
| 28 | 28 | | (f) The Ending Homelessness fund is created as a trust fund |
|---|
| 29 | 29 | | outside the state treasury to be held by the comptroller and |
|---|
| 30 | 30 | | administered by the Texas Department of Housing and Community |
|---|
| 31 | 31 | | Affairs as trustee. The fund is composed of money deposited to the |
|---|
| 32 | 32 | | credit of the fund under this section. Money in the fund shall be |
|---|
| 33 | 33 | | used to provide grants to counties and municipalities to combat |
|---|
| 34 | 34 | | homelessness, including, as applicable, a county or municipality |
|---|
| 35 | 35 | | with which the Texas Department of Housing and Community Affairs |
|---|
| 36 | 36 | | coordinates to operate the transitional housing pilot program under |
|---|
| 37 | 37 | | Section 2306.258, Government Code. |
|---|
| 38 | 38 | | (g) The Texas Department of Housing and Community Affairs |
|---|
| 39 | 39 | | shall: |
|---|
| 40 | 40 | | (1) adopt rules governing application for grants from |
|---|
| 41 | 41 | | the Ending Homelessness fund and the issuance of those grants; and |
|---|
| 42 | 42 | | (2) give priority in issuing grants from the fund to |
|---|
| 43 | 43 | | counties and municipalities that coordinate with the Texas |
|---|
| 44 | 44 | | Department of Housing and Community Affairs in the operation of the |
|---|
| 45 | 45 | | transitional housing pilot program under Section 2306.258, |
|---|
| 46 | 46 | | Government Code. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2021. |
