55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the operation of a transitional housing pilot program
88 by the Texas Department of Housing and Community Affairs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.258, Government Code, is amended by
1111 amending Subsection (a) and adding Subsections (c) and (d) to read
1212 as follows:
1313 (a) With money contributed to the Ending Homelessness fund
1414 under Section 502.415, Transportation Code [If funds are
1515 available], the department shall operate a transitional housing
1616 pilot program in four areas of this [the] state.
1717 (c) The department may:
1818 (1) operate the program in coordination with one or
1919 more counties or municipalities; and
2020 (2) provide a grant from the Ending Homelessness fund
2121 under Section 502.415, Transportation Code, to a county or
2222 municipality with which the department coordinates to operate the
2323 program.
2424 (d) The department may adopt rules as necessary to implement
2525 this section.
2626 SECTION 2. Sections 502.415(f) and (g), Transportation
2727 Code, are amended to read as follows:
2828 (f) The Ending Homelessness fund is created as a trust fund
2929 outside the state treasury to be held by the comptroller and
3030 administered by the Texas Department of Housing and Community
3131 Affairs as trustee. The fund is composed of money deposited to the
3232 credit of the fund under this section. Money in the fund shall be
3333 used to provide grants to counties and municipalities to combat
3434 homelessness, including, as applicable, a county or municipality
3535 with which the Texas Department of Housing and Community Affairs
3636 coordinates to operate the transitional housing pilot program under
3737 Section 2306.258, Government Code.
3838 (g) The Texas Department of Housing and Community Affairs
3939 shall:
4040 (1) adopt rules governing application for grants from
4141 the Ending Homelessness fund and the issuance of those grants; and
4242 (2) give priority in issuing grants from the fund to
4343 counties and municipalities that coordinate with the Texas
4444 Department of Housing and Community Affairs in the operation of the
4545 transitional housing pilot program under Section 2306.258,
4646 Government Code.
4747 SECTION 3. This Act takes effect September 1, 2021.
