| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 11.0581, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (a) Except as provided by Subsection (a-1), an [An] election |
|---|
| 14 | 14 | | for trustees of an independent school district shall be held on the |
|---|
| 15 | 15 | | same date as: |
|---|
| 16 | 16 | | (1) the election for the members of the governing body |
|---|
| 17 | 17 | | of a municipality located in the school district; |
|---|
| 18 | 18 | | (2) the general election for state and county |
|---|
| 19 | 19 | | officers; |
|---|
| 20 | 20 | | (3) the election for the members of the governing body |
|---|
| 21 | 21 | | of a hospital district, if the school district: |
|---|
| 22 | 22 | | (A) is wholly or partly located in a county with a |
|---|
| 23 | 23 | | population of less than 40,000 that is adjacent to a county with a |
|---|
| 24 | 24 | | population of more than three million; and |
|---|
| 25 | 25 | | (B) held its election for trustees jointly with |
|---|
| 26 | 26 | | the election for the members of the governing body of the hospital |
|---|
| 27 | 27 | | district before May 2007; or |
|---|
| 28 | 28 | | (4) the election for the members of the governing |
|---|
| 29 | 29 | | board of a public junior college district in which the school |
|---|
| 30 | 30 | | district is wholly or partly located. |
|---|
| 31 | 31 | | (a-1) An election for the board of trustees of an |
|---|
| 32 | 32 | | independent school district with the largest student enrollment in |
|---|
| 33 | 33 | | a county with a population of 550,000 or more that is adjacent to a |
|---|
| 34 | 34 | | county with a population of 3.3 million or more shall be held on the |
|---|
| 35 | 35 | | November uniform election date as a joint election under Chapter |
|---|
| 36 | 36 | | 271, Election Code, with any other election occurring on that date |
|---|
| 37 | 37 | | in all or part of the same county. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2021. |
