95 AN ACT
106 relating to notice of the right to object to participation in an
117 abortion procedure for health care personnel of a hospital or
128 health care facility.
139 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1410 SECTION 1. Chapter 103, Occupations Code, is amended by
1511 adding Section 103.005 to read as follows:
16- Sec. 103.005. REQUIRED NOTICE. (a) A hospital or health
17- care facility at which abortions are performed, including a
18- facility licensed under Chapter 245, Health and Safety Code, shall
19- post a sign in a location easily visible to each physician, nurse,
20- staff member, or employee of the hospital or facility who performs
21- or participates or may perform or participate in an abortion
22- procedure.
23- (b) The sign must inform each physician, nurse, staff
24- member, or employee that:
12+ Sec. 103.005. REQUIRED NOTICE. A hospital or health care
13+ facility shall provide written notice to each physician, nurse,
14+ staff member, or employee of the hospital or facility that:
2515 (1) the individual has a right to object to directly or
2616 indirectly performing or participating in an abortion procedure;
27- (2) the hospital or health care facility is prohibited
28- from discriminating against the individual for refusing to perform
29- or participate in an abortion procedure; and
17+ (2) the hospital or facility is prohibited from
18+ discriminating against the individual for refusing to perform or
19+ participate in an abortion procedure; and
3020 (3) the individual may be entitled to a remedy,
3121 including injunctive relief, affirmative relief, and any other
3222 necessary relief, under Section 103.003 for a violation of the
3323 individual's right to object.
34- (c) The sign must be:
35- (1) at least 11 inches by 17 inches in size and written
36- in at least a 16-point font; and
37- (2) posted separately in:
38- (A) English;
39- (B) Spanish; and
40- (C) any other primary language spoken by 10
41- percent or more of the hospital or health care facility's
42- physicians, nurses, staff members, or employees who perform or
43- participate or may perform or participate in an abortion procedure.
4424 SECTION 2. This Act takes effect September 1, 2021.
