| 7 | 7 | | relating to the sale of distilled spirits at a temporary location by |

| 8 | 8 | | the holder of a distiller's and rectifier's permit. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 14, Alcoholic Beverage Code, is amended |
|---|
| 11 | 11 | | by adding Section 14.09 to read as follows: |
|---|
| 12 | 12 | | Sec. 14.09. SALES AT TEMPORARY LOCATION. (a) The holder of |
|---|
| 13 | 13 | | a distiller's and rectifier's permit may sell distilled spirits at a |
|---|
| 14 | 14 | | civic or distilled spirits festival, farmers' market, celebration, |
|---|
| 15 | 15 | | or similar event. |
|---|
| 16 | 16 | | (b) The holder of a distiller's and rectifier's permit may |
|---|
| 17 | 17 | | not offer distilled spirits for sale under this section on more than |
|---|
| 18 | 18 | | four consecutive days at the same location. |
|---|
| 19 | 19 | | (c) The commission shall adopt rules to implement this |
|---|
| 20 | 20 | | section, including rules that: |
|---|
| 21 | 21 | | (1) require the permit holder to notify the commission |
|---|
| 22 | 22 | | of the dates on which and location where the permit holder will |
|---|
| 23 | 23 | | temporarily offer distilled spirits for sale under this section; |
|---|
| 24 | 24 | | (2) establish a procedure to verify the wet or dry |
|---|
| 25 | 25 | | status of the location where the permit holder intends to |
|---|
| 26 | 26 | | temporarily sell distilled spirits under this section; |
|---|
| 27 | 27 | | (3) detail the circumstances when a permit holder may |
|---|
| 28 | 28 | | temporarily sell distilled spirits under this section with just a |
|---|
| 29 | 29 | | notification to the commission and the circumstances that require |
|---|
| 30 | 30 | | the commission's preapproval before a permit holder may temporarily |
|---|
| 31 | 31 | | sell distilled spirits under this section; and |
|---|
| 32 | 32 | | (4) require the permit holder to provide any other |
|---|
| 33 | 33 | | information the commission determines necessary. |
|---|
| 34 | 34 | | (d) The provisions of this code applicable to the sale of |
|---|
| 35 | 35 | | distilled spirits on the permitted premises of the holder of a |
|---|
| 36 | 36 | | distiller's and rectifier's permit apply to the sale of distilled |
|---|
| 37 | 37 | | spirits under this section. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2021. |
