66 AN ACT
77 relating to an academic distinction designation for high student
88 achievement under the public school accountability system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.202, Education Code, is amended to
1111 read as follows:
1212 Sec. 39.202. ACADEMIC DISTINCTION DESIGNATIONS
1313 [DESIGNATION] FOR DISTRICTS AND CAMPUSES. (a) The commissioner by
1414 rule shall establish an academic distinction designation for
1515 districts and campuses for outstanding performance in attainment of
1616 postsecondary readiness. The commissioner shall adopt criteria for
1717 the designation under this subsection [section], including:
1818 (1) percentages of students who:
1919 (A) performed satisfactorily, as determined
2020 under the college readiness performance standard under Section
2121 39.0241, on assessment instruments required under Section
2222 39.023(a), (b), (c), or (l), aggregated across grade levels by
2323 subject area; or
2424 (B) met the standard for annual improvement, as
2525 determined by the agency under Section 39.034, on assessment
2626 instruments required under Section 39.023(a), (b), (c), or (l),
2727 aggregated across grade levels by subject area, for students who
2828 did not perform satisfactorily as described by Paragraph (A);
2929 (2) percentages of:
3030 (A) students who earned a nationally or
3131 internationally recognized business or industry certification or
3232 license;
3333 (B) students who completed a coherent sequence of
3434 career and technical courses;
3535 (C) students who completed a dual credit course
3636 or an articulated postsecondary course provided for local credit;
3737 (D) students who achieved applicable College
3838 Readiness Benchmarks or the equivalent on the Preliminary
3939 Scholastic Assessment Test (PSAT), the Scholastic Assessment Test
4040 (SAT), the American College Test (ACT), or the ACT-Plan assessment
4141 program; and
4242 (E) students who received a score on either an
4343 advanced placement test or an international baccalaureate
4444 examination to be awarded college credit; and
4545 (3) other factors for determining sufficient student
4646 attainment of postsecondary readiness.
4747 (b) In addition to the distinction designation described by
4848 Subsection (a), the commissioner by rule shall establish an
4949 academic distinction designation for districts and campuses for
5050 outstanding performance in attainment of high student achievement.
5151 The commissioner shall adopt criteria for the designation under
5252 this subsection, including percentages of students who:
5353 (1) have earned a diploma after not more than three and
5454 one-half years of high school attendance;
5555 (2) in grade seven or eight, complete a pre-advanced
5656 placement course or pre-international baccalaureate course;
5757 (3) have been promoted to higher grade levels than the
5858 grade levels to which the students would ordinarily be assigned;
5959 (4) are identified as gifted and talented and have
6060 been promoted to higher grade levels than the grade levels to which
6161 the students would ordinarily be assigned;
6262 (5) have received credit by examination;
6363 (6) are identified as gifted and talented and have
6464 received credit by examination; and
6565 (7) complete not less than 10 project-based learning
6666 projects during a school year.
6767 SECTION 2. This Act applies beginning with the 2021-2022
6868 school year.
6969 SECTION 3. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2021.
