79 relating to the establishment of a task force to conduct a
810 comprehensive study on best practice standards for the confinement
911 of pregnant prisoners in county jails.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. (a) A task force is established to conduct a
1214 comprehensive study on best practice standards for the confinement
1315 of pregnant prisoners in county jails. The study must identify and
1416 make recommendations regarding the following with respect to the
1517 confinement of pregnant prisoners:
1618 (1) current policies and procedures;
1719 (2) barriers to accommodations and justice;
1820 (3) best practices used in other states;
1921 (4) policies that would improve jail standards; and
2022 (5) any other issue the task force considers
2123 appropriate.
2224 (b) The Commission on Jail Standards shall appoint the
2325 members of the task force. The task force must include at least:
2426 (1) one representative of the Commission on Jail
2527 Standards;
2628 (2) one representative of a statewide organization
2729 that advocates for incarcerated women;
2830 (3) one representative of a statewide organization
2931 that represents corrections professionals;
3032 (4) one representative of a county jail;
3133 (5) one member who is a mental health professional;
3234 (6) one member who is an obstetrician or gynecologist;
3335 (7) one member who is a doula providing culturally
3436 responsive care;
3537 (8) one member who was pregnant while incarcerated;
3638 and
3739 (9) one member who is a certified reentry peer support
3840 specialist.
3941 (c) The member appointed under Subsection (b)(1) of this
4042 section serves as the presiding officer of the task force.
4143 (d) The task force shall prepare a written report that
4244 includes:
4345 (1) a description of the activities of the task force;
4446 (2) the findings and recommendations of the task
4547 force;
4648 (3) a plan for how the best practice standards
4749 identified by the task force can be implemented statewide;
4850 (4) any proposals for legislation; and
4951 (5) any other matter the task force considers
5052 appropriate.
5153 (e) Not later than December 1, 2022, the task force shall
5254 submit the report prepared under this section to:
5355 (1) the governor;
5456 (2) the lieutenant governor;
5557 (3) the speaker of the house of representatives; and
5658 (4) the presiding officers of the standing committees
5759 of the senate and house of representatives having primary
5860 jurisdiction over issues relating to criminal justice.
5961 (f) The Commission on Jail Standards shall make the report
6062 available to the public on the commission's Internet website.
6163 (g) The task force is abolished and this Act expires
6264 September 1, 2023.
6365 SECTION 2. This Act takes effect September 1, 2021.
