86 AN ACT
9- relating to manufacturing requirements for hardware and software
10- used in a voting system used in an election in this state.
7+ relating to a requirement that all components of a voting system
8+ used in an election in this state be manufactured, stored, and held
9+ in the United States by a company headquartered in the United
10+ States.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 122.032, Election Code, is amended by
13- amending Subsection (a) and adding Subsection (c) to read as
14- follows:
12+ SECTION 1. Section 122.032(a), Election Code, is amended to
13+ read as follows:
1514 (a) For a voting system or voting system equipment to be
1615 approved for use in elections, the voting system in which the
1716 equipment is designed to be used must:
1817 (1) comply with the standards prescribed by Subchapter
1918 A; and
20- (2) beginning September 1, 2021, have:
21- (A) all software used in the voting system be
22- developed and operated entirely within the United States and sold
23- by a company whose:
24- (i) headquarters are located in the United
19+ (2) beginning September 1, 2021, have all components
20+ of the voting system, including equipment, individual component
21+ pieces, and data storage manufactured, stored, and held in the
22+ United States and sold by a company whose:
23+ (A) headquarters are located in the United
2524 States; and
26- (ii) parent company's headquarters, if
27- applicable, are located in the United States; and
28- (B) all hardware used in the voting system, if
29- manufactured outside the United States, be delivered to the United
30- States without any embedded software installed.
31- (c) In this section, "embedded software" means programmable
32- instructions provided on software that is delivered with voting
33- system equipment or with a replacement part for that equipment for
34- the purpose of equipment operation, including all relevant patches
35- and fixes made by the original equipment manufacturer of the voting
36- system equipment or replacement part for that purpose.
25+ (B) parent company's headquarters, if
26+ applicable, are located in the United States.
3727 SECTION 2. This Act takes effect immediately if it receives
3828 a vote of two-thirds of all the members elected to each house, as
3929 provided by Section 39, Article III, Texas Constitution. If this
4030 Act does not receive the vote necessary for immediate effect, this
4131 Act takes effect September 1, 2021.
