66 AN ACT
77 relating to notice provided to a court regarding a defendant
88 confined in a state jail felony facility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 42A.558, Code of Criminal Procedure, is
1111 amended by adding Subsections (b-1) and (b-2) to read as follows:
1212 (b-1) On request of the judge, the Texas Department of
1313 Criminal Justice shall, not later than the 60th day after the date
1414 the defendant is received into the custody of a state jail felony
1515 facility, notify the judge of the date on which the defendant will
1616 have served 75 days in the facility. The notice must be provided by
1717 e-mail or other electronic communication.
1818 (b-2) For purposes of Subsection (b-1), the judge may submit
1919 a single request to the Texas Department of Criminal Justice with
2020 respect to all applicable defendants sentenced in the judge's
2121 court.
2222 SECTION 2. The change in law made by this Act to Article
2323 42A.558, Code of Criminal Procedure, applies only to a defendant
2424 who receives a sentence of confinement in a state jail on or after
2525 the effective date of this Act. A defendant who receives a sentence
2626 of confinement in a state jail before the effective date of this Act
2727 is governed by the law in effect at the time of sentencing, and the
2828 former law is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect September 1, 2021.
