6	6	AN ACT
7	7	relating to a certificate of birth resulting in stillbirth.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 192.0022(a)(1), Health and Safety Code,
10	10	is amended to read as follows:
11	11	(1) "Stillbirth" means an unintended, intrauterine
12	12	fetal death occurring in this state [after a gestational age of not
13	13	less than 20 completed weeks].
14	14	SECTION 2. Section 192.0022, Health and Safety Code, is
15	15	amended by amending Subsections (b), (c), (g), and (h) and adding
16	16	Subsections (d-1) and (h-1) to read as follows:
17	17	(b) The person who is required to file a fetal death
18	18	certificate under Section 193.002, on filing of any required fetal
19	19	death certificate or if otherwise involved in the disposition of
20	20	the stillborn child's remains, shall advise the parent or parents
21	21	of a stillborn child:
22	22	(1) that a parent may, but is not required to, request
23	23	the preparation of a certificate of birth resulting in stillbirth;
24	24	(2) that a parent may obtain a certificate of birth
25	25	resulting in stillbirth by contacting the vital statistics unit to
26	26	request the certificate and paying the required fee; and
27	27	(3) regarding the way or ways in which a parent may
28	28	contact the vital statistics unit to request the certificate.
29	29	(c) A parent may provide a name for a stillborn child on the
30	30	request for a certificate of birth resulting in stillbirth. If the
31	31	requesting parent does not wish to provide a name, the vital
32	32	statistics unit shall fill in the certificate with the name "baby
33	33	boy" or "baby girl" and the last name of the parent. [The name of
34	34	the stillborn child provided on or later added by amendment to the
35	35	certificate of birth resulting in stillbirth shall be the same name
36	36	as placed on the original or amended fetal death certificate.]
37	37	(d-1) The department shall issue a certificate of birth
38	38	resulting in stillbirth at the request of a parent of the stillborn
39	39	child.
40	40	(g) On issuance of a certificate of birth resulting in
41	41	stillbirth to a parent who has requested the certificate as
42	42	provided by this section, the vital statistics unit shall file an
43	43	exact copy of the certificate with the local registrar of the
44	44	registration district in which the stillbirth occurred. [The local
45	45	registrar shall file the certificate of birth resulting in
46	46	stillbirth with the fetal death certificate.]
47	47	(h) A parent may request the vital statistics unit to issue
48	48	a certificate of birth resulting in stillbirth without regard to
49	49	the date on which the birth resulting in stillbirth occurred [fetal
50	50	death certificate was issued].
51	51	(h-1) A certificate of birth resulting in stillbirth is not
52	52	a fetal death certificate for purposes of Section 193.002, and the
53	53	issuance of a certificate of birth resulting in stillbirth under
54	54	this section does not affect the issuance of a fetal death
55	55	certificate under Section 193.002.
56	56	SECTION 3. Section 192.0022(d), Health and Safety Code, is
57	57	repealed.
58	58	SECTION 4. This Act takes effect September 1, 2021.
