55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the publication of certain information regarding
88 certain disciplinary appeals filed by police officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 411, Government Code, is
1111 amended by adding Section 411.056 to read as follows:
1212 Sec. 411.056. REPORTING ON POLICE OFFICER DISCIPLINARY
1313 APPEAL HEARINGS. The department shall publish on the department's
1414 Internet website the information reported to the department under
1515 Section 180.008, Local Government Code.
1616 SECTION 2. Chapter 180, Local Government Code, is amended
1717 by adding Section 180.008 to read as follows:
1818 Sec. 180.008. ARBITRATOR REPORTING REGARDING CERTAIN
1919 DISCIPLINARY APPEAL HEARINGS FOR POLICE OFFICERS. An arbitrator
2020 selected to hear an appeal of the disciplinary suspension or
2121 dismissal of a municipal police officer, deputy sheriff, deputy
2222 constable, or other police officer, including an appeal under
2323 Section 143.057 or 143.1016 or under a collective bargaining, meet
2424 and confer, or other similar agreement, shall report to the
2525 Department of Public Safety of the State of Texas, for each hearing
2626 arbitrated by the arbitrator:
2727 (1) the ruling in the hearing;
2828 (2) the date of the ruling;
2929 (3) sources of the arbitrator's payment; and
3030 (4) amounts paid to the police officer as a result of
3131 the ruling in the hearing.
3232 SECTION 3. Section 180.008, Local Government Code, as added
3333 by this Act, applies only to a disciplinary appeal that is initiated
3434 on or after the effective date of this Act.
3535 SECTION 4. This Act takes effect September 1, 2021.
