| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, |
|---|
| 13 | 13 | | is amended by adding Section 33.0181 to read as follows: |
|---|
| 14 | 14 | | Sec. 33.0181. CONTINUED ELIGIBILITY OF HOUSEHOLD FOR SNAP |
|---|
| 15 | 15 | | ON INELIGIBILITY OF HEAD OF HOUSEHOLD FOR FAILURE TO COMPLY WITH |
|---|
| 16 | 16 | | CERTAIN WORK REQUIREMENTS. If the head of household becomes |
|---|
| 17 | 17 | | ineligible to participate in the supplemental nutrition assistance |
|---|
| 18 | 18 | | program because the head of household failed to comply with work |
|---|
| 19 | 19 | | requirements under 7 U.S.C. Section 2015(d)(1)(A), the other |
|---|
| 20 | 20 | | members of the household are not ineligible for program benefits on |
|---|
| 21 | 21 | | that basis and the commission may not determine the household |
|---|
| 22 | 22 | | ineligible under 7 U.S.C. Section 2015(d)(1)(B) to participate in |
|---|
| 23 | 23 | | the program. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies to a |
|---|
| 25 | 25 | | person who receives benefits under the supplemental nutrition |
|---|
| 26 | 26 | | assistance program on or after the effective date of this Act, |
|---|
| 27 | 27 | | regardless of the date on which eligibility for benefits under the |
|---|
| 28 | 28 | | program was determined. |
|---|
| 29 | 29 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 30 | 30 | | a state agency determines that a waiver or authorization from a |
|---|
| 31 | 31 | | federal agency is necessary for implementation of that provision, |
|---|
| 32 | 32 | | the agency affected by the provision shall request the waiver or |
|---|
| 33 | 33 | | authorization and may delay implementing that provision until the |
|---|
| 34 | 34 | | waiver or authorization is granted. |
|---|
| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2021. |
