66 AN ACT
77 relating to continued household eligibility for supplemental
88 nutrition assistance program benefits on the ineligibility of the
99 head of household for failure to comply with certain work
1010 requirements.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1313 is amended by adding Section 33.0181 to read as follows:
1414 Sec. 33.0181. CONTINUED ELIGIBILITY OF HOUSEHOLD FOR SNAP
1515 ON INELIGIBILITY OF HEAD OF HOUSEHOLD FOR FAILURE TO COMPLY WITH
1616 CERTAIN WORK REQUIREMENTS. If the head of household becomes
1717 ineligible to participate in the supplemental nutrition assistance
1818 program because the head of household failed to comply with work
1919 requirements under 7 U.S.C. Section 2015(d)(1)(A), the other
2020 members of the household are not ineligible for program benefits on
2121 that basis and the commission may not determine the household
2222 ineligible under 7 U.S.C. Section 2015(d)(1)(B) to participate in
2323 the program.
2424 SECTION 2. The change in law made by this Act applies to a
2525 person who receives benefits under the supplemental nutrition
2626 assistance program on or after the effective date of this Act,
2727 regardless of the date on which eligibility for benefits under the
2828 program was determined.
2929 SECTION 3. If before implementing any provision of this Act
3030 a state agency determines that a waiver or authorization from a
3131 federal agency is necessary for implementation of that provision,
3232 the agency affected by the provision shall request the waiver or
3333 authorization and may delay implementing that provision until the
3434 waiver or authorization is granted.
3535 SECTION 4. This Act takes effect September 1, 2021.
