| 7 | 7 | | relating to the coverage and provision of abortion under a health |
|---|
| 8 | 8 | | benefit plan and certain programs administered by this state. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.024, Human Resources Code, is amended |
|---|
| 11 | 11 | | by amending Subsection (e) and adding Subsection (mm) to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (e) The commission may not authorize the provision of any |
|---|
| 14 | 14 | | service to any person under the program unless federal matching |
|---|
| 15 | 15 | | funds are available to pay the cost of the service, except that the |
|---|
| 16 | 16 | | commission shall provide abortion services regardless of whether |
|---|
| 17 | 17 | | federal matching funds are available to pay for the cost of those |
|---|
| 18 | 18 | | services. |
|---|
| 19 | 19 | | (mm) The commission shall provide abortion services under |
|---|
| 20 | 20 | | the medical assistance program in accordance with applicable state |
|---|
| 21 | 21 | | and federal law. |
|---|
| 22 | 22 | | SECTION 2. The following provisions are repealed: |
|---|
| 23 | 23 | | (1) Section 32.005, Health and Safety Code; |
|---|
| 24 | 24 | | (2) Section 32.024(c-1), Human Resources Code; |
|---|
| 25 | 25 | | (3) Chapter 1218, Insurance Code; and |
|---|
| 26 | 26 | | (4) Subtitle M, Title 8, Insurance Code. |
|---|
| 27 | 27 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 28 | 28 | | a state agency determines that a waiver or authorization from a |
|---|
| 29 | 29 | | federal agency is necessary for implementation of that provision, |
|---|
| 30 | 30 | | the agency affected by the provision shall request the waiver or |
|---|
| 31 | 31 | | authorization and may delay implementing that provision until the |
|---|
| 32 | 32 | | waiver or authorization is granted. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect September 1, 2021. |
