| 7 | 7 | | relating to a notification requirement concerning the availability |
|---|
| 8 | 8 | | of nurses on the campus of a public school, including an |
|---|
| 9 | 9 | | open-enrollment charter school. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 25, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 25.096 to read as follows: |
|---|
| 13 | 13 | | Sec. 25.096. PARENTAL NOTIFICATION CONCERNING NURSES. (a) |
|---|
| 14 | 14 | | In this section, "nurse" means a person licensed under Chapter 301, |
|---|
| 15 | 15 | | Occupations Code. |
|---|
| 16 | 16 | | (b) A public school, including an open-enrollment charter |
|---|
| 17 | 17 | | school, shall provide written notice to the parent of or other |
|---|
| 18 | 18 | | person standing in parental relation to each student enrolled in |
|---|
| 19 | 19 | | the school concerning the schedule and availability of a nurse on |
|---|
| 20 | 20 | | the school's campus during the school year. |
|---|
| 21 | 21 | | (c) The principal of the school shall provide the notice |
|---|
| 22 | 22 | | required by Subsection (b) not later than the 30th instructional |
|---|
| 23 | 23 | | day following: |
|---|
| 24 | 24 | | (1) the first day of school; and |
|---|
| 25 | 25 | | (2) any change to the nurse's schedule or availability |
|---|
| 26 | 26 | | that occurs during the school year. |
|---|
| 27 | 27 | | (d) The school shall: |
|---|
| 28 | 28 | | (1) make a good faith effort to ensure that the notice |
|---|
| 29 | 29 | | required by this section is provided in a bilingual form to any |
|---|
| 30 | 30 | | parent or other person standing in parental relation whose primary |
|---|
| 31 | 31 | | language is not English; and |
|---|
| 32 | 32 | | (2) retain a copy of any notice provided under this |
|---|
| 33 | 33 | | section. |
|---|
| 34 | 34 | | (e) A school may satisfy the notice requirement under |
|---|
| 35 | 35 | | Subsection (c) by posting the notice on the school's Internet |
|---|
| 36 | 36 | | website. Notice posted under this subsection must be accessible |
|---|
| 37 | 37 | | from the home page of the Internet website by use of not more than |
|---|
| 38 | 38 | | three links. |
|---|
| 39 | 39 | | SECTION 2. This Act applies beginning with the 2021-2022 |
|---|
| 40 | 40 | | school year. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2021. |
