66 AN ACT
77 relating to a notification requirement concerning the availability
88 of nurses on the campus of a public school, including an
99 open-enrollment charter school.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 25, Education Code, is
1212 amended by adding Section 25.096 to read as follows:
1313 Sec. 25.096. PARENTAL NOTIFICATION CONCERNING NURSES. (a)
1414 In this section, "nurse" means a person licensed under Chapter 301,
1515 Occupations Code.
1616 (b) A public school, including an open-enrollment charter
1717 school, shall provide written notice to the parent of or other
1818 person standing in parental relation to each student enrolled in
1919 the school concerning the schedule and availability of a nurse on
2020 the school's campus during the school year.
2121 (c) The principal of the school shall provide the notice
2222 required by Subsection (b) not later than the 30th instructional
2323 day following:
2424 (1) the first day of school; and
2525 (2) any change to the nurse's schedule or availability
2626 that occurs during the school year.
2727 (d) The school shall:
2828 (1) make a good faith effort to ensure that the notice
2929 required by this section is provided in a bilingual form to any
3030 parent or other person standing in parental relation whose primary
3131 language is not English; and
3232 (2) retain a copy of any notice provided under this
3333 section.
3434 (e) A school may satisfy the notice requirement under
3535 Subsection (c) by posting the notice on the school's Internet
3636 website. Notice posted under this subsection must be accessible
3737 from the home page of the Internet website by use of not more than
3838 three links.
3939 SECTION 2. This Act applies beginning with the 2021-2022
4040 school year.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2021.
