76 AN ACT
87 relating to professional liability insurance coverage for and
98 prohibitions on the provision to certain children of procedures and
109 treatments for gender transitioning, gender reassignment, or
1110 gender dysphoria.
1211 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1312 SECTION 1. Chapter 161, Health and Safety Code, is amended
1413 by adding Subchapter X to read as follows:
1514 SUBCHAPTER X. GENDER TRANSITIONING AND GENDER REASSIGNMENT
1615 PROCEDURES AND TREATMENTS FOR CERTAIN CHILDREN
1716 Sec. 161.701. DEFINITIONS. In this subchapter:
1817 (1) "Child" means an individual who is younger than 18
1918 years of age.
2019 (2) "Health care provider" means a person other than a
2120 physician who is licensed, certified, or otherwise authorized by
2221 the laws of this state to provide or render health care or to
2322 dispense or prescribe a prescription drug in the ordinary course of
2423 business or practice of a profession.
2524 (3) "Physician" means a person licensed to practice
2625 medicine in this state.
2726 Sec. 161.702. PROHIBITED PROVISION OF GENDER TRANSITIONING
2827 OR GENDER REASSIGNMENT PROCEDURES AND TREATMENTS TO CERTAIN
2928 CHILDREN. For the purpose of transitioning a child's biological
3029 sex as determined by the sex organs, chromosomes, and endogenous
3130 profiles of the child or affirming the child's perception of the
3231 child's sex if that perception is inconsistent with the child's
3332 biological sex, a physician or other health care provider may not:
3433 (1) perform a surgery that sterilizes the child,
3534 including:
3635 (A) castration;
3736 (B) vasectomy;
3837 (C) hysterectomy;
3938 (D) oophorectomy;
4039 (E) metoidioplasty;
4140 (F) orchiectomy;
4241 (G) penectomy;
4342 (H) phalloplasty; and
4443 (I) vaginoplasty;
4544 (2) perform a mastectomy;
4645 (3) provide, administer, prescribe, or dispense any of
4746 the following prescription drugs that induce transient or permanent
4847 infertility:
4948 (A) puberty suppression or blocking prescription
5049 drugs to stop or delay normal puberty;
5150 (B) supraphysiologic doses of testosterone to
5251 females; or
5352 (C) supraphysiologic doses of estrogen to males;
5453 or
5554 (4) remove any otherwise healthy or non-diseased body
5655 part or tissue.
5756 Sec. 161.703. EXCEPTIONS. The prohibitions under Section
5857 161.702 do not apply to the provision by a physician or other health
5958 care provider, with the consent of the child's parent or legal
6059 guardian, of appropriate and medically necessary gender
6160 transitioning or gender reassignment procedures or treatments to a
6261 child who:
6362 (1) is born with a medically verifiable genetic
6463 disorder of sex development, including:
6564 (A) 46, XX chromosomes with virilization;
6665 (B) 46, XY chromosomes with undervirilization;
6766 or
6867 (C) both ovarian and testicular tissue; or
6968 (2) does not have the normal sex chromosome structure
7069 for male or female as determined by a physician through genetic
7170 testing.
7271 SECTION 2. Subchapter F, Chapter 1901, Insurance Code, is
7372 amended by adding Section 1901.256 to read as follows:
7473 Sec. 1901.256. PROHIBITED COVERAGE FOR PROVISION OF CERTAIN
7574 GENDER-RELATED PROCEDURES AND TREATMENTS TO CERTAIN CHILDREN. A
7675 professional liability insurance policy issued to a physician or
7776 health care provider may not include coverage for damages assessed
7877 against the physician or health care provider who provides to a
7978 child gender transitioning or gender reassignment procedures or
8079 treatments that are prohibited by Section 161.702, Health and
8180 Safety Code.
8281 SECTION 3. Section 164.052, Occupations Code, is amended by
8382 amending Subsection (a) and adding Subsection (d) to read as
8483 follows:
8584 (a) A physician or an applicant for a license to practice
8685 medicine commits a prohibited practice if that person:
8786 (1) submits to the board a false or misleading
8887 statement, document, or certificate in an application for a
8988 license;
9089 (2) presents to the board a license, certificate, or
9190 diploma that was illegally or fraudulently obtained;
9291 (3) commits fraud or deception in taking or passing an
9392 examination;
9493 (4) uses alcohol or drugs in an intemperate manner
9594 that, in the board's opinion, could endanger a patient's life;
9695 (5) commits unprofessional or dishonorable conduct
9796 that is likely to deceive or defraud the public, as provided by
9897 Section 164.053, or injure the public;
9998 (6) uses an advertising statement that is false,
10099 misleading, or deceptive;
101100 (7) advertises professional superiority or the
102101 performance of professional service in a superior manner if that
103102 advertising is not readily subject to verification;
104103 (8) purchases, sells, barters, or uses, or offers to
105104 purchase, sell, barter, or use, a medical degree, license,
106105 certificate, or diploma, or a transcript of a license, certificate,
107106 or diploma in or incident to an application to the board for a
108107 license to practice medicine;
109108 (9) alters, with fraudulent intent, a medical license,
110109 certificate, or diploma, or a transcript of a medical license,
111110 certificate, or diploma;
112111 (10) uses a medical license, certificate, or diploma,
113112 or a transcript of a medical license, certificate, or diploma that
114113 has been:
115114 (A) fraudulently purchased or issued;
116115 (B) counterfeited; or
117116 (C) materially altered;
118117 (11) impersonates or acts as proxy for another person
119118 in an examination required by this subtitle for a medical license;
120119 (12) engages in conduct that subverts or attempts to
121120 subvert an examination process required by this subtitle for a
122121 medical license;
123122 (13) impersonates a physician or permits another to
124123 use the person's license or certificate to practice medicine in
125124 this state;
126125 (14) directly or indirectly employs a person whose
127126 license to practice medicine has been suspended, canceled, or
128127 revoked;
129128 (15) associates in the practice of medicine with a
130129 person:
131130 (A) whose license to practice medicine has been
132131 suspended, canceled, or revoked; or
133132 (B) who has been convicted of the unlawful
134133 practice of medicine in this state or elsewhere;
135134 (16) performs or procures a criminal abortion, aids or
136135 abets in the procuring of a criminal abortion, attempts to perform
137136 or procure a criminal abortion, or attempts to aid or abet the
138137 performance or procurement of a criminal abortion;
139138 (17) directly or indirectly aids or abets the practice
140139 of medicine by a person, partnership, association, or corporation
141140 that is not licensed to practice medicine by the board;
142141 (18) performs an abortion on a woman who is pregnant
143142 with a viable unborn child during the third trimester of the
144143 pregnancy unless:
145144 (A) the abortion is necessary to prevent the
146145 death of the woman;
147146 (B) the viable unborn child has a severe,
148147 irreversible brain impairment; or
149148 (C) the woman is diagnosed with a significant
150149 likelihood of suffering imminent severe, irreversible brain damage
151150 or imminent severe, irreversible paralysis;
152151 (19) performs an abortion on an unemancipated minor
153152 without the written consent of the child's parent, managing
154153 conservator, or legal guardian or without a court order, as
155154 provided by Section 33.003 or 33.004, Family Code, unless the
156155 abortion is necessary due to a medical emergency, as defined by
157156 Section 171.002, Health and Safety Code;
158157 (20) otherwise performs an abortion on an
159158 unemancipated minor in violation of Chapter 33, Family Code;
160159 (21) performs or induces or attempts to perform or
161160 induce an abortion in violation of Subchapter C, F, or G, Chapter
162161 171, Health and Safety Code; [or]
163162 (22) in complying with the procedures outlined in
164163 Sections 166.045 and 166.046, Health and Safety Code, wilfully
165164 fails to make a reasonable effort to transfer a patient to a
166165 physician who is willing to comply with a directive; or
167166 (23) for the purpose of facilitating the gender
168167 transition or treating the gender dysphoria of an unemancipated
169168 minor:
170169 (A) provides, administers, prescribes, or
171170 dispenses a puberty suppression or blocking prescription drug or
172171 cross-sex hormone to the minor, including by writing a false or
173172 fictitious prescription; or
174173 (B) performs or attempts to perform a surgical
175174 intervention on the minor.
176175 (d) Notwithstanding Subsection (a)(23), a physician or
177176 applicant for a license to practice medicine does not commit a
178177 prohibited practice if the physician or applicant provides a
179178 puberty suppression or blocking prescription drug to an
180179 unemancipated minor for the purpose of normalizing puberty for a
181180 minor experiencing precocious puberty.
182181 SECTION 4. Section 1901.256, Insurance Code, as added by
183182 this Act, applies only to a medical professional liability
184183 insurance policy that is delivered, issued for delivery, or renewed
185184 on or after January 1, 2022. An insurance policy that is delivered,
186185 issued for delivery, or renewed before January 1, 2022, is governed
187186 by the law in effect immediately before the effective date of this
188187 Act, and that law is continued in effect for that purpose.
189188 SECTION 5. Section 164.052, Occupations Code, as amended by
190189 this Act, applies only to conduct that occurs on or after the
191190 effective date of this Act. Conduct that occurs before the
192191 effective date of this Act is governed by the law in effect on the
193192 date the conduct occurred, and the former law is continued in effect
194193 for that purpose.
195194 SECTION 6. This Act takes effect September 1, 2021.
