411 AN ACT
512 relating to the imposition of consecutive sentences for certain
613 offenses arising out of the same criminal episode.
714 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
815 SECTION 1. Section 3.03(b), Penal Code, is amended to read
916 as follows:
1017 (b) If the accused is found guilty of more than one offense
1118 arising out of the same criminal episode, the sentences may run
1219 concurrently or consecutively if each sentence is for a conviction
1320 of:
1421 (1) an offense:
1522 (A) under Section 49.07 or 49.08, regardless of
1623 whether the accused is convicted of violations of the same section
1724 more than once or is convicted of violations of both sections; or
1825 (B) for which a plea agreement was reached in a
1926 case in which the accused was charged with more than one offense
2027 listed in Paragraph (A), regardless of whether the accused is
2128 charged with violations of the same section more than once or is
2229 charged with violations of both sections;
2330 (2) an offense:
2431 (A) under Section 33.021 or an offense under
2532 Section 21.02, 21.11, 22.011, 22.021, 25.02, or 43.25 committed
2633 against a victim younger than 17 years of age at the time of the
2734 commission of the offense regardless of whether the accused is
2835 convicted of violations of the same section more than once or is
2936 convicted of violations of more than one section; or
3037 (B) for which a plea agreement was reached in a
3138 case in which the accused was charged with more than one offense
3239 listed in Paragraph (A) committed against a victim younger than 17
3340 years of age at the time of the commission of the offense regardless
3441 of whether the accused is charged with violations of the same
3542 section more than once or is charged with violations of more than
3643 one section;
3744 (3) an offense:
3845 (A) under Section 21.15 or 43.26, regardless of
3946 whether the accused is convicted of violations of the same section
4047 more than once or is convicted of violations of both sections; or
4148 (B) for which a plea agreement was reached in a
4249 case in which the accused was charged with more than one offense
4350 listed in Paragraph (A), regardless of whether the accused is
4451 charged with violations of the same section more than once or is
4552 charged with violations of both sections;
4653 (4) an offense for which the judgment in the case
4754 contains an affirmative finding under Article 42.0197, Code of
4855 Criminal Procedure;
4956 (5) an offense:
5057 (A) under Section 20A.02, 20A.03, or 43.05,
5158 regardless of whether the accused is convicted of violations of the
5259 same section more than once or is convicted of violations of more
5360 than one section; or
5461 (B) for which a plea agreement was reached in a
5562 case in which the accused was charged with more than one offense
5663 listed in Paragraph (A), regardless of whether the accused is
5764 charged with violations of the same section more than once or is
5865 charged with violations of more than one section; [or]
5966 (6) an offense:
6067 (A) under Section 22.04(a)(1) or (2) or Section
6168 22.04(a-1)(1) or (2) that is punishable as a felony of the first
6269 degree, regardless of whether the accused is convicted of
6370 violations of the same section more than once or is convicted of
6471 violations of more than one section; or
6572 (B) for which a plea agreement was reached in a
6673 case in which the accused was charged with more than one offense
6774 listed in Paragraph (A) and punishable as described by that
6875 paragraph, regardless of whether the accused is charged with
6976 violations of the same section more than once or is charged with
7077 violations of more than one section; or
7178 (7) any combination of offenses listed in Subdivisions
7279 (1)-(6).
7380 SECTION 2. The change in law made by this Act applies only
7481 to an offense committed on or after the effective date of this Act.
7582 An offense committed before the effective date of this Act is
7683 governed by the law in effect on the date the offense was committed,
7784 and the former law is continued in effect for that purpose. For
7885 purposes of this section, an offense was committed before the
7986 effective date of this Act if any element of the offense occurred
8087 before that date.
8188 SECTION 3. This Act takes effect September 1, 2021.
