911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter A, Chapter 552, Government Code, is
1113 amended by adding Section 552.0031 to read as follows:
1214 Sec. 552.0031. BUSINESS DAYS. (a) Except as provided by
1315 this section, in this chapter "business day" means a day other than
1416 a:
1517 (1) Saturday or Sunday;
1618 (2) national holiday under Section 662.003(a); or
1719 (3) state holiday under Section 662.003(b).
1820 (b) An optional holiday under Section 662.003(c) is not a
1921 business day of a governmental body if the officer for public
2022 information of the governmental body observes the optional holiday.
2123 (c) A holiday established by the governing body of an
2224 institution of higher education under Section 662.011(a) is not a
2325 business day of the institution of higher education.
24- (d) The Friday before or Monday after a holiday described by
25- Subsection (a)(2) or (3) is not a business day of a governmental
26- body if the holiday occurs on a Saturday or Sunday and the
27- governmental body observes the holiday on that Friday or Monday.
28- (e) Subject to the requirements of this subsection, a
29- governmental body may designate a day on which the governmental
30- body's administrative offices are closed or operating with minimum
31- staffing as a non-business day. The designation of a non-business
32- day for an independent school district must be made by the board of
33- trustees. The designation of a non-business day for a governmental
34- body other than an independent school district must be made by the
35- executive director or other chief administrative officer. A
36- governmental body may designate not more than 10 non-business days
37- under this subsection each calendar year. A governmental body
38- shall make a good faith effort to post advance notice of the
39- non-business days designated under this subsection on the
40- governmental body's Internet website.
26+ (d) A day designated as a non-business day under this
27+ subsection by the governing body of an independent school district
28+ or institution of higher education, as defined by Section 61.003,
29+ Education Code, is not a business day of the independent school
30+ district or institution of higher education. A governing body may
31+ designate not more than 20 non-business days under this subsection
32+ each calendar year. An independent school district or institution
33+ of higher education must post a list of the non-business days for a
34+ calendar year on its Internet website on or before the first day of
35+ the school or academic year during which the calendar year begins.
4136 SECTION 2. The change in law made by this Act applies only
4237 to a request for public information received by a governmental body
4338 or officer for public information on or after the effective date of
4439 this Act.
4540 SECTION 3. This Act takes effect September 1, 2021.
