86 AN ACT
9- relating to required training on trauma-impacted veterans for
7+ relating to required training on trauma affected veterans for
108 certain peace officers.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 1701.352(b), Occupations Code, is
13- amended to read as follows:
14- (b) The commission shall require a state, county, special
15- district, or municipal agency that appoints or employs peace
16- officers to provide each peace officer with a training program at
17- least once every 48 months that is approved by the commission and
18- consists of:
19- (1) topics selected by the agency; and
20- (2) for an officer holding only a basic proficiency
21- certificate, not more than 20 hours of education and training that
22- contain curricula incorporating the learning objectives developed
23- by the commission regarding:
24- (A) civil rights, racial sensitivity, and
25- cultural diversity;
26- (B) de-escalation and crisis intervention
27- techniques to facilitate interaction with persons with mental
28- impairments, including training on identifying and interacting
29- with trauma-impacted veterans and training on diverting those
30- veterans to available community resources;
31- (C) de-escalation techniques to facilitate
32- interaction with members of the public, including techniques for
33- limiting the use of force resulting in bodily injury; and
34- (D) unless determined by the agency head to be
35- inconsistent with the officer's assigned duties:
36- (i) the recognition, documentation, and
37- investigation of cases that involve child abuse or neglect, family
38- violence, and sexual assault, including the use of best practices
39- and trauma-informed techniques to effectively recognize, document,
40- and investigate those cases; and
41- (ii) issues concerning sex offender
42- characteristics.
43- SECTION 2. As soon as practicable after the effective date
44- of this Act, the Texas Commission on Law Enforcement shall adopt
45- rules necessary to implement Section 1701.352(b), Occupations
46- Code, as amended by this Act.
10+ SECTION 1. Section 1701.351, Occupations Code, is amended
11+ by adding Subsection (e) to read as follows:
12+ (e) Not later than the last day of the first full continuing
13+ education training period that begins after the date a peace
14+ officer completes four cumulative years of service as a peace
15+ officer, the officer shall complete, in addition to the other
16+ training required by this section, the training program established
17+ under Section 1701.265.
18+ SECTION 2. (a) The change in law made by this Act applies to
19+ a peace officer licensed under Chapter 1701, Occupations Code,
20+ regardless of whether the license was issued before, on, or after
21+ the effective date of this Act.
22+ (b) Notwithstanding Section 1701.351(e), Occupations Code,
23+ as added by this Act, a peace officer who on the effective date of
24+ this Act has four or more cumulative years of service shall complete
25+ the training program established under Section 1701.265,
26+ Occupations Code, not later than the last day of the first full
27+ continuing education training period that begins on or after the
28+ effective date of this Act.
4729 SECTION 3. This Act takes effect September 1, 2021.
