55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition and duties of the Public Health Funding
88 and Policy Committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 117.052, Health and Safety Code, is
1111 amended to read as follows:
1212 Sec. 117.052. APPOINTMENT OF MEMBERS. (a) The commissioner
1313 shall appoint 10 [nine] members to the committee as follows:
1414 (1) two regional health directors, each of whom is
1515 serving as a health authority in a municipality or county;
1616 (2) one local health entity representative of a
1717 municipality or county with a population of 50,000 or less;
1818 (3) one local health entity representative from a
1919 municipality or county with a population greater than 50,000 but
2020 less than 250,000;
2121 (4) one local health entity representative from a
2222 municipality or county with a population of at least 250,000;
2323 (5) two local health entity representatives, each of
2424 whom serves in a municipality or county as the health authority;
2525 [and]
2626 (6) two representatives of schools or programs of
2727 public health at institutions of higher education in this state;
2828 and
2929 (7) one representative from the Task Force of Border
3030 Health Officials established under Chapter 120.
3131 (a-1) The committee members appointed under Subsection
3232 (a)(1) are ex officio nonvoting members.
3333 (b) In making appointments under Subsections (a)(2), (3),
3434 (4), [and] (5), (6), and (7), the commissioner shall select the
3535 members from nominations submitted by the entity, institution, or
3636 task force of which the nominated member is an employee or member
3737 [associations representing local health departments, county
3838 governments, and municipal governments].
3939 SECTION 2. Section 117.053(a), Health and Safety Code, is
4040 amended to read as follows:
4141 (a) Committee members serve staggered six-year terms, with
4242 the terms of three or four members expiring on February 1 of each
4343 odd-numbered year.
4444 SECTION 3. Section 117.055, Health and Safety Code, is
4545 amended to read as follows:
4646 Sec. 117.055. PRESIDING OFFICER. The presiding officer is
4747 elected by a majority vote of all the committee members and serves
4848 for a term of two years.
4949 SECTION 4. Section 117.056, Health and Safety Code, is
5050 amended by adding Subsection (c) to read as follows:
5151 (c) The committee shall meet with the Task Force of Border
5252 Health Officials established under Chapter 120 at least annually
5353 and at the call of the presiding officers of the committee and the
5454 task force.
5555 SECTION 5. Section 117.101, Health and Safety Code, is
5656 amended to read as follows:
5757 Sec. 117.101. GENERAL DUTIES OF COMMITTEE. (a) The
5858 committee shall:
5959 (1) summarize the scope and type of [define the core]
6060 public health services provided by [a] local health entities, with
6161 a focus on differences in the availability of services in urban,
6262 rural, and border areas of this state [entity should provide in a
6363 county or municipality];
6464 (2) monitor the availability of [evaluate] public
6565 health services in this state, [and] identify the disparity between
6666 services and funding for those services, and develop
6767 recommendations to address the disparity [initiatives for areas
6868 that need improvement];
6969 (3) recommend [identify all funding sources available
7070 for use by local health entities to perform core public health
7171 functions;
7272 [(4) establish public] health issue [policy]
7373 priorities for this state and coordinate efforts to address the
7474 priorities with the department; and
7575 (4) [(5)] at least biennially [annually], make formal
7676 recommendations to the department regarding:
7777 (A) the use and allocation of funds available
7878 exclusively to local health entities to perform core public health
7979 functions;
8080 (B) ways to improve the overall public health of
8181 citizens in this state;
8282 (C) methods for transitioning from a contractual
8383 relationship between the department and the local health entities
8484 to a cooperative-agreement relationship between the department and
8585 the local health entities; and
8686 (D) methods for fostering a continuous
8787 collaborative relationship between the department and the local
8888 health entities.
8989 (b) Recommendations made under Subsection (a)(4)(A)
9090 [(a)(5)(A)] must be in accordance with:
9191 (1) prevailing epidemiological evidence, variations
9292 in geographic and population needs, best practices, and
9393 evidence-based interventions related to the populations to be
9494 served;
9595 (2) state and federal law; and
9696 (3) federal funding requirements.
9797 SECTION 6. The heading to Section 117.151, Health and
9898 Safety Code, is amended to read as follows:
9999 Sec. 117.151. BIENNIAL [ANNUAL] REPORT.
100100 SECTION 7. Section 117.151(a), Health and Safety Code, is
101101 amended to read as follows:
102102 (a) Not [Beginning in 2012, not] later than November 30 of
103103 each even-numbered year the department shall file a biennial [an
104104 annual] report with the governor, the lieutenant governor, and the
105105 speaker of the house of representatives detailing:
106106 (1) the implementation of the committee's
107107 recommendations described in Section 117.101(a)(4)
108108 [117.101(a)(5)]; and
109109 (2) an explanation of the department's reasons for not
110110 implementing a recommendation.
111111 SECTION 8. Section 120.054, Health and Safety Code, is
112112 amended by adding Subsection (c) to read as follows:
113113 (c) The task force shall meet with the Public Health Funding
114114 and Policy Committee established under Chapter 117 at least
115115 annually and at the call of the presiding officers of the task force
116116 and the committee.
117117 SECTION 9. As soon as practicable after the effective date
118118 of this Act, the commissioner of public health of the Department of
119119 State Health Services shall make the appointment required by
120120 Section 117.052(a)(7), Health and Safety Code, as added by this
121121 Act.
122122 SECTION 10. This Act takes effect September 1, 2021.
