79 relating to property owners' association annual meetings held

911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 209.014(a), Property Code, is amended to
1113 read as follows:
1214 (a) Notwithstanding any provision in a dedicatory
1315 instrument, a board of a property owners' association shall call an
1416 annual meeting of the members of the association. An annual meeting
1517 may be held by any method of communication, including electronic or
1618 telephonic means as described by Section 6.002, Business
1719 Organizations Code, provided that:
1820 (1) each person in attendance at the meeting may hear
1921 and be heard by every other person at the meeting; and
2022 (2) the notice of the meeting sent to members of the
2123 association includes instructions to access any communication
2224 method required to attend the meeting remotely.
2325 SECTION 2. Section 209.00592(a-1), Property Code, is
2426 amended to read as follows:
2527 (a-1) Except as provided by this subsection, [unless a
2628 dedicatory instrument provides otherwise,] a property owners'
2729 association is not required to provide an owner with more than one
2830 voting method. An owner must be allowed to vote by one of the
2931 following voting methods:
3032 (1) absentee ballot;
3133 (2) [or] proxy; or
3234 (3) electronic ballot.
3335 SECTION 3. This Act takes effect immediately if it receives
3436 a vote of two-thirds of all the members elected to each house, as
3537 provided by Section 39, Article III, Texas Constitution. If this
3638 Act does not receive the vote necessary for immediate effect, this
3739 Act takes effect September 1, 2021.
