66 AN ACT
77 relating to liability of a recreational vehicle park or campground
88 entity for injuries arising from certain activities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 75B to read as follows:
1212 CHAPTER 75B. LIMITED LIABILITY FOR RECREATIONAL VEHICLE PARK AND
1313 CAMPGROUND ACTIVITIES
1414 Sec. 75B.001. DEFINITIONS. In this chapter:
1515 (1) "Campground" means a commercial property designed
1616 to provide cabins for transient guest use or areas for locating
1717 recreational vehicles or tents for transient guest use.
1818 (2) "Campground entity" means a person engaged in the
1919 business of owning or operating a campground.
2020 (3) "Recreational vehicle park" has the meaning
2121 assigned by Section 13.087, Water Code.
2222 (4) "Recreational vehicle park entity" means a person
2323 engaged in the business of owning or operating a recreational
2424 vehicle park.
2525 (5) "Recreational vehicle park or campground
2626 activity" means an activity at a recreational vehicle park or
2727 campground for recreational or educational purposes.
2828 (6) "Recreational vehicle park or campground
2929 participant" means an individual, other than an employee of a
3030 recreational vehicle park or campground entity, who engages in a
3131 recreational vehicle park or campground activity.
3232 (7) "Recreational vehicle park or campground
3333 participant injury" means an injury sustained by a recreational
3434 vehicle park or campground participant, including bodily injury,
3535 emotional distress, death, property damage, or any other loss
3636 arising from the person's conduct of or participation in a
3737 recreational vehicle park or campground activity.
3838 Sec. 75B.002. LIMITED LIABILITY. (a) Except as provided
3939 by Subsection (b), a recreational vehicle park or campground entity
4040 is not liable to any person for a recreational vehicle park or
4141 campground participant injury or damages arising out of a
4242 recreational vehicle park or campground participant injury if, at
4343 the time of the recreational vehicle park or campground activity
4444 from which the injury arises, the warning prescribed by Section
4545 75B.003 was posted in accordance with that section.
4646 (b) This section does not limit liability for an injury:
4747 (1) proximately caused by:
4848 (A) the recreational vehicle park or campground
4949 entity's negligence evidencing a disregard for the safety of the
5050 recreational vehicle park or campground participant;
5151 (B) a potentially dangerous condition on the
5252 land, facilities, or equipment used in the activity, of which the
5353 recreational vehicle park or campground entity had actual knowledge
5454 or reasonably should have known; or
5555 (C) the recreational vehicle park or campground
5656 entity's failure to train or improper training of an employee of the
5757 recreational vehicle park or campground entity actively involved in
5858 a recreational vehicle park or campground activity; or
5959 (2) intentionally caused by the recreational vehicle
6060 park or campground entity.
6161 (c) A limitation on liability provided by this section to a
6262 recreational vehicle park or campground entity is in addition to
6363 other limitations of liability.
6464 Sec. 75B.003. POSTED WARNING. For the purposes of
6565 limitation of liability under Section 75B.002(a), a recreational
6666 vehicle park or campground entity must post and maintain a sign in a
6767 clearly visible location on or near the recreational vehicle park
6868 or campground. The sign must contain the following language:
6969 WARNING
7070 UNDER TEXAS LAW (CHAPTER 75B, CIVIL PRACTICE AND REMEDIES CODE), A
7171 RECREATIONAL VEHICLE PARK OR CAMPGROUND ENTITY IS NOT LIABLE FOR
7272 ANY INJURY TO OR DEATH OF A RECREATIONAL VEHICLE PARK OR CAMPGROUND
7373 PARTICIPANT RESULTING FROM A RECREATIONAL VEHICLE PARK OR
7474 CAMPGROUND ACTIVITY.
7575 SECTION 2. The change in law made by this Act applies only
7676 to a cause of action that accrues on or after the effective date of
7777 this Act.
7878 SECTION 3. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2021.
